Okay, I have a few questions with regards to the A&L.
I sent off my SAR for the statements from 4 accounts that I had with the Alliance and Leicester.
Unfortunately I didn't have any bank account numbers, so sent them all the information to know that it was me.
After the 40 days, they sent me statements for only 1 of the accounts.
They have failed to send me any other information. I sent them a reminder letter and told them I would complain to the OFT, if I didn't receive the statements within 7 days.
Ok, Now for the questions.
Question 1 : That time has now passed - what is the next step?
How and where do I send my complaint - is it the OFT or fos?
Question 2 : I have also sent my request for charges to be refunded.
They owe me approx £1200, on an account that I only owe £600 and have been in a DPM with.
Am I eligible to get all the defaults on this account removed.
Question 3 : This account was passed to a DCA, do they have to send me the cheque directly, or will they send it to the DCA. What will happen to the excess, is that mine or will they try and take it off 1 of the other loan accounts??
Finally, Question 4 : If it goes to the court stage, I do not have the money at the moment to go to court. Do you have to file in court, or can you complain to the FOS or OFT instead?
Sorry, Question 5 : This is more of a general question, if you go to court, and win, do they send you a cheque for all charges inc court fees and interest etc, or do they take it off your outstanding balance? As I could not afford to pay the court fees and then have them taken off the outstanding balance?
I am at the court stage now and have just filed my claim. but if you go to court ( which is very unlikely as they seem to be paying up before hand) you will get back your court fees and the additional fee of £100 if your claime is more than £1500.. you can also claime back any expensives you have had also. as lone as you win your case.
sorry but i am not to sure if you no this but.. the additional £100 has to be payed by you other wise your case will be thrown out of court and then the A&L wins. which we dont want to happen. but good luck with your case. and hope i have help even a little bit...
