    Default Long delay since first letters.

    Very sorry, but really need some advice.
    I started a claim against Abbeyicon May/June 2006 with all the appropriate letters to Abbey. I got to the lbaicon stage on a claim of £5000. They made a good faith payment of £750 into my account before i could respond. I never responded to them on this.
    However this is now my dilema. Just at that time my wife was taken very ill and i had to leave this and other matters. I now want to continue with the action. Can i start from the last point which was the LBA that i had sent, and just proceed to filing the court papers?, or do i have to start all over again?

    Advice would be welcome on both the fact that they have made a good faith payment and the time delay.

    Have you spent the cash? Also did they send you a letter regarding the GOGW payment? If so do you still have the letter and can you post the details of the letter.

    I will have to look the letter out and post the details of the GOGW payment. But as to spending it, yes at the time it just got swollowed up in normal living expenses.

    If it was paid out before any court action just deduct the sum from your claim and start again.

    Start off with the preliminary letter just to be sure as it has been a while since the last communication.

    Any conditions which they may have imposed on the settlement are not binding.
