    Default HELP - Barclaycard have sold me on!!!

    Can somebody help with this this please?

    Making claim against Barclaycard. Got statements (eventually - but thats another story), meanwhile Credit Solutions trying to collect on behalf of Barlcaycard. Just before christmas, Credit Solutions advise Barclaycard will reduce debt by 45% (but apparently thats as far as they go!). Credit Solutions then tell me file is going back to Barclaycard. Nothing more is heard - let sleeping dogs lie thinks I, while Im dealing wiht RBSicon and Abbeyicon.

    Now got letter from HFO Services Limited advising that Barclaycard have sold the debt to them and that " As a property owner your account is being dealt with by a specialist division at HFO which deals solely with the needs and responsibilities of home owners in debt."

    I interpret this to mean they will attempt to obtain a charging order asap. also they do not right off debts or any part thereof! Charming!

    How does this leave my claim against Barlcaycard - can they just avoid their responsibilities by selling the debt to a factoring company? Does anyone know of a relationship between HFO and Barclaycard?

    Any help and advice urgenlty required as apparently they will "...puruse this matter with or without my cooperation"..

    What do I do next then?

    I am no legal expert, that said however, I would very much doubt that Barclaysicon can obviate their legal responsibility for imposing penalty charges on your account simply by selling or transferring the debt.

    To my mind, its a bit like someone driving a car that they know to be un-roadworthy, having an accident and then selling the car on and trying to blame the accident on the new owner. As far as I can see, the original owner would still be responsible for the accident, irrespective of who now owns the car. I would say that the same would apply to your claim against Barclaycard; Barclays have charged their unlawful penalties, they have had their pound of flesh, so go get em. However, don't expect a speedy resolution, it took me six months to bring Barclaycard to book...

    Don't panic these are just scare tactics.
    As the account is in disputeicon they cannot collect.

    send them this letter:
    ACCOUNT IN DISPUTE
    Dear Sir/Madam

    Re: Account Number: XXXXXXX



    I would like to inform you that the balance of this account is in dispute with the original creditor.

    Therefore I consider this account to be in dispute and no further action shall be taken until this matter is resolved


    I look forward to hearing from you in writing.

    Yours faithfully


    Blah
    That should keep them quiet while you persue Barclaysicon.

    If they do come back with something similar or other threats then CCA them to make sure they have ALL the correct paper work to persue this debt.
