This is my first post, and this is what I have done so far.
I went into my local Natwest, and had the list of charges posted to me. This cost £5, and came within two working days. I was quite shocked on how quickly it arrive.
I have sent my first letter requesting (Time and date recorded on the 21/03/2007) requesting the total sum of £2788.00 for Penalty & unfair charges. I have given them 14days notice, with the reserved right to commence court proceedings without any further notice, and to seek an additional award for distress and inconvenience, together with legal expenses.
I have not heard from Natwest as yet, I will be sticking to my 14 day deadline.
Ian,
Don't run before you can walk. additional awards under small claims i think are not possible. In fast track you are allowed to claim expenses. What i am trying to say is that if you try for anything you are not entitled to. When you start your court proceedings they may try to strike out your case. Don't give them any ammo to use against you. Have a look at this might help you. Good luck http://www.consumeractiongroup.co.uk...se-read-these/
Thank you for the advice, It is really nice to have support on this
With regards to the additional awards, prehaps I should of left that part out of my letter, I thought I would use that line to get grab thier attetion.
And mine. Yaaaaaaaaaaaay. Go get em. All the best. Fendy xxxx

I was going to send the second letter after the 14days, is this the correct way? and shall the second letter have a 7 day deadline or a 14 day deadline? thanks
My 14 days are going to be up on the 4th, and I still have not heard from Nat West. My only concern I have at the moment is I made quite a mistake on the amount I was claiming back. I did not minus the subscription fee for the ADV Gold from the charges on my account. I know I cannot claim that back since it is a subscription I pay for, but shall I send out a revision to the charges in my next letter?
On another positive note, I had another £40 charge on my account this Saturday being the end of the month and all. I gave Nat west a call, who explained it was the £12 pound subscription and a £28 pound unarranged borrowing fee for my overdraft, but as soon as I said "hmmm... £28 pounds! That’s seems quite high", he put me on hold for a minute, and then without and hassle on his side said they will refund the charge instantly.
I have made two mistakes when sending out my Preliminary letter,
Firstly, I did not deduct the ADV gold subscription from my bank charges, and secondly I send the Preliminary letter to the bank manager at my Nat West branch, where I had the account opened.
I have the new total amount deducting the adv gold subscription, do I need to send out another Preliminary letter to the Nat West Customer Relations, or do I send out the lba to my bank manager with the new revised amount?

Hi Ian
Don't panic the bank manager would have passed your letter onto the right place via internal mail it takes a couple of days longer but always get's to the right place.
Just send your revised charges with your lba like lively lads advice above and fingers crossed it won't be too long before a reply

It's been 14days since I have sent my lba to Natwest customer relations. I have not heard anything at all since I have started the claim. Shall I give Natwest Customer relations a call? or move on to the next step?
