Firstly, I have had Hamptons on my back for the Barclays Bank Debt from several years ago - I graduated in 2001, so the graduate account defaulted around about November 2001 nearly 6 yearsago. However I have had dealings with them and Hamptons and probably other debt collectors
I can't remember the names of now. I never sent an SAR
to Barclays because this site wasn't up and running then.
Can I send an SARto them after all this time? What if they cannot provide evidence of my account? And if they do, what do I do with this now?
Also, I sent an SAR to NatWest over my illegal charges last year - around Jan/Feb 2006, and the statements they sent were incomplete. I gather data was lost when the got taken over by RSB. I want to persue the litigation again but cna fathom the best place to start as I've just had so much go on in the year. I want to also write some sort of letter back to Bryan Carter & Co re the NatWest debt they are persuing.
Their letter reads:
I am not worried as the first letter I sent them said thus:We acknowledge reciept of you recent communication.
We note you have raised a dispute with regards to charges applied to you account. Our view is that whilst you may be partially successful in this arguement, it is certainly not the case that all charges levied are irrecoverable.
In an attempt to bring this matter to a conclusion we confirm that on a without prejudicebasis we will accept £831.05 in full and final settlement providing the payment is received within 28 days of the date of this letter.
If you choose not to accept this compromise out instructions are to take enforcement action against you without further notice.

I write in reference to the above account held by yourselves. I telephoned your offices twice in the last week regarding this matter.
The monies you claim I owe to you as a National Westminster Bank Plc debt, I refute 100%. I do not owe this money to NatWest or yourselves as this fake and illegal debt was created by NatWest imposing illegal bank charges upon a current account I once had with them.
I am gathering my evidence to take NatWest to court over this matter. I am, however, a full time carer for my sick and disabled mother who has dementia, and thus getting this to court will take me time. However, I do have 7 years to bring this before the British Judicial System.
Your company is not the only debt collectors who have tried to collect this illegal debt and each time they are aware it is subject to future legal proceedings by me, they appear to sell this debt on elsewhere. I would imagine that Fredrickson International Ltd would not wish to be seen to have harassed an innocent member of the public once this matter gets to court.
I would like confirmation in writing that there will be no further pursuance of this fake and illegal debt from Fredrickson International Ltd or any associated subsidiary companies, such as Bryan Carter & Co Solicitors who have also recently written to me acting on your behalf.
