    Default £10 SAR Fee question

    In the SARicon it says we will apply for this back if we discover they have levied penalties.

    So far I have been told by the companies we cannot get it back.

    I thought they were allowed to charge an adminicon fee for a Data Protection request (photocopying costs etc) so on what grounds do we claim it back?

    Fistly don't believe what the companies have been telling you.

    They take hundreds or thousands in unlawful penalties. Why do you suddenly trust them for £10?

    The basis for claiming the £10 back is that if having received your statements you find that they have charged you unlawfully then you are justified in saying that it was their unlawful behaviour which obliged you to seek the data disclosureicon in the first place.

    If they don't like this and eventually offer you everything except for the £10 - then stick to your guns. It will be a game of chicken as to who wil blink first. Be ruthless.
    They may want to frighten you by taking you to the wire. Show them that you are prepared to go to the wire and over it if needs be.
    Add the £10 to your claim

    They are thuggish bullies. treat them with contempt.

    Wow Bankfodder, Im honoured to have your reply on my thread. I will insist on it back. I was thinking on those grounds but wanted to double check.
    I used to work in a benefits section and we were allowed to charge for photocopying etc (not that we ever did) so that was why I wanted to make sure I wouldnt come unstuck.
