    Angry Cahoot charges

    I have a Cahoot current account, which thankfully is not my main account. I have four other bank accounts and have never been charged for anything in over 15 years of banking. Well near christmas I was out shopping and forgot my credit and debit cards, my daughter wanted an urgent present so as luck would have it my Cahoot debit card was in my jacket. I new I had a £250.00 overdrafticon and so proceeded to take out the balance that was left and some of the overdraft. Well xmas eve computer just dies, very busy at work and other commitments and yesterday managed to purchase new system and install. Well to my surprise I find e-mails by the dozen from cahoot nothing important on them except to say charges applied to account. When I finally find my log in I am horrified to find that with the interest it put me over the limit. £30.00 from December to March total £90.00. I have today sent a cheque to cover the overdraft and the possible o/d fee for this month. When I contacted them to justifiy this charge, I was met with the usuall you should have read the fees etc.

    I am going to follow the advice of this site and ask them to refund me these extoranate charges. I have not asked for the interest back.

    Do I stand a chance or should I just put it down to bad luck. First time in 32 years I have ever received a charge on any bank, credit card or other.

    For £90.00 is it worth it????? What happens if I lose in the small claims court, can they ask for legal costs???

    Yes, you can claim the charges back.

    Yes, it's worth it - it's YOUR money.

    Yes, you can claim the interesticon they have charged you - you should also include your own interest to compensate you for the period they have had your money.

    No, if you loose at Court you can't have costs awarded against you.

    Cahoot have already paid me over £2K

    Northern Rock; S.A.R sent 11/8/06 - Delivered. Recieved details of 6 yrs charges on 8th. Wrote back asking whether or not they hold information going back further than that.
    MBNA; S.A.R sent 11/8/06 - Delivered 14/8/06
    Barclays; S.A.R - (Subject Access Request) request sent 11/8/06 - Del 14/8/06
    Diners Club; S.A.R sent 11/8/06 - Delivered 14/8/06. Recieved form to fill and return with fee on 17/8/06. Sent form back, delivered 4/9/06.
    Intelligent Finance; Prelim letter emailed 16/08/06, claiming £318. Email recieved from "Anne-Marie" 17/8/06 saying my email has been passed to Customer Relations dept. Fob-off letter received 23/8/06, letter sent in return same day - Delivered 24/8/6 Recieved letter offer 25% settelement - refused - LBA sent. MCOL on 10th revcieved notification that they intend to defend on 13th. 06/9/2006 WON!!!!!!

    I can confirm that bank charges are yet under review to confirm whether they are unfair.

    Please remember, the onus of the running of the account is the account holder's
    responsibility. Therefore you must ensure that there are sufficient funds in
    your account to cover any payments or direct debits that are due.

    As advised in our previous email ' If you remain dissatisfied though you can find details of how to take your complaint further within Abbeyicon at http://www.cahoot.com/legal/legal.html#importantInfo under the heading 'Complaints policy'. The complaints policy also explains your ultimate right to refer your complaint to the Financial Ombudsmanicon Service.'

    this is the fourth e-mail from them, this one is now beginning to show a change of tone, the last three said in no uncertain terms bog off, hmmmm

    I have just replied again telling them they have 14 days to return a measley £90.00 or see them in court. Also told them to look at my banking history with em, never, never have I incurred bank charges in all my time with em.
