I sent a SAR to Halifax Trinity RD, recorded delivery, with a cheque. I reseved no response, and no cheque was cashed. I checked with the royal Mail and they have " no records" to whether it was or wasn't delivered. I sent a second reminder, with a copy of the original SAR but no check. This letter was delivered on 01/03/07, but i have had no response. The account is closed so i have no online access. Should I resend with a cheque or start court proceedings?
I rang them this week. After being pu through to the wrong departments, made to cue longer than usual, spoken to like i was taking their jobs away i eventually spoke to someone who had a clue. He said that Halifax usually cash cheques asap, but the department dealing with SAR's was swomped so he would send a summary of my charges over the last 6 years. I understand that this could affect what i could claim for. While I am not worried, I believe you would need full statment if you wish to claim contractual intrest? I let you know what arrives.

If they have just sent a list of charges and nothing else, then they are in breach of the DPA.
You asked and paid for....
A complete list of transactions and charges relating to my banking history with your organisation. Alternatively, a complete set of statements for that period will be acceptable.
To be supplied with just a list of charges is failure of the DPA.
You could send the non compliance letter as they havnt sent you a complete set of statements.

i've just had the same from halifaxs, just 6 occasions when i was "DR", no details of charges and only going back to 01/01/03
Non compliance noticed sent. Thay hadn't cashed the first cheque for some reason so i sent another copy and gave the 14 days. I've sent a request for refund for the £305 of charges, they have notified me of.
On 15th June(Recieved Saturday 16th) Halifax offered £335.85 and gave me 7 days to respond. On Tuesday 19th a letter arrived dated 18th June with a cheque for "Full and final settlement." Offer rejected.
