hey everyone. I completed my claim online last night so am now waiting the 5 days for Barclays to be served.
Made a bit of a mistake though, I have copies of all correspondance that I have had with Barclays except one letter that I sent tham rejecting the partial offer they gave me. Will this have an impact on my case or am I worrying for nothing
Cheers everyone, Ill keep you all posted on how its going from now
Have learnt my lesson and now keep two copies of everything and dend everything recorded delivery, 3 more days until the 5 days is up and I can assume Barclays has been served
when you file on MCOL and send a schedule of charges to them your also meant to send one to Barclays, is it best to send it to there 1 churchill place adress or to their solicitors, if the answer is their solicitors then hoe do you find out the adress as its not on the contact page on this website.

Hi Fitzo - I sent a copy of my schedule of charges to Barclays using the 1 Churchill Place address.
hey everyone, just an update. Barclays acknowledged my claim on, suprise suprise, the last day, and then filed their defence on the 27th day, so Im now waiting for my aq to come through
Im going to use the new strategy for the allocation questionaire and was wondering if anyone else had done this with Barclays as I have a question about the court bundle. (I know I dont need it yet but want to be prepared). If anyone has been through this yet I would really appreciate it if you would let me know. either leave a post or PM, Cheers in advance
by the way Im already adding up my charges from Lloyds. theres no stopping me now
LOL
Looks like youve done your homework and swatted up on the aq's
Shame you probably wont use all that knowledge.
A lot of cases are skipping the AQ stage now and transferring to your local court, this is merely to speed things up as judges are becoming wise to the fact banks are simply playing the system.
You will get notification if the AQ is dispensed with shortly.
Cheers Dar£n. Id heard they were dispensing of the aq's, but didnt know how common that was.
I really have been swatting up. I actually find the whole thing really interesting. although sometimes after 5 hrs of reading posts, you just cant take anymore and have to rest, lol
so if it is dispensed of does that meen the judge will skip straight to the sending in of court bundles. That would be great
you were right dar£n, Ive just had a letter from my local court saying my claim has been transferred to them and that the judge has dispensed with the filing of aq's. brilliant.
It has the defence that Barclays filed attached to it but not much else. I take it I dont have to do anything at this stage,
Am I just waiting to hear from the court again now about sending in bundles and hearing dates?
Cohen's: WON (discontinued) DLC: Given up, gone away. Eversheds: Trying! Equidebt: In default Intrum J: Return to OC iQor: Stopped paying. Link: In default. ScotCall: Return to OC Thames: Stopped paying.
I am NOT a legal or financial expert. There are many CAG members and staff who are better qualified. Please do not make major decisions based on my advice alone.
still waiting to hear from the court but I know this can take a while. My clai m has gone to birmingham cc, which is where Judge Cooke made that rediculous ruling the other day, Luckily I have a different Judge.
when it says we need your litigation, do I just PM a mod with details of my case
I have just received a letter from birmingham court stating
UPON CONSIDERING THIS MATTER
IT IS ORDERED THAT
Unless the claimant by 4.00pm on 8th June files at court and serves on the defendant further written particulars of the claim specifying the name, account number and sorting code of the account referred to and a list of all the charges complained of showing the date and amount of each one and the stated reason for it, the claim shall stand struck out without further order
I have already sent a list of charges to the bank and a list to the court when I filed on MCOL both were recorded delivery and in all of my correspondance I have started with my account number, it is even in my POCs.
