Hi! This is my first post but I have been following various forums and posts in great detail. Couldn't find anything similar to mine so here goes:
I requested access to my bank statements which I received from Cahoot on 9/1/2007. I subsequently submitted the second letter template on the 11th of January.
I eventually got an email from cahoot - Kamalpal Hir informed me that I was of course wrong in claiming my money back ... bla ... bla ... bla.
On Wednesday 21st of Feb I wrote to them again - this time at the Abbey Complaints address as instructed by Cahoot - giving 7 days. On March 1st they responded apologising that it will take a further 4 (!) weeks to respond. Sure enough I have had another letter on the 22nd of March informing me once again that they will need another 4 (!) weeks.
I called several times - no joy.
Should I give them more time or just claim. They told me that they had 8 weeks as per the regulations, I thought it was 4.
This is just a delaying tactic, I think they send the same letter to everyone. Carry on with your timetable. If you informed them in your last letter that you would commence court action in 14 days then go for it. File your MCOL.
According to THEIR OWN internal rules Abbey give themselves 8 weeks to investigate a complaint. They have reminded me several times you cannot take the complaint to the FSA until they send a final letter and that takes 8 weeks.
I told them that I have no intention of complaing to the FSA and the courts only require 2 weeks. If you intend to pursue this in court then send them a letter before action giving a 2 week deadline to refund the money in full.
They will try and put you off and will request more time.
