Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I took Lloyds to court twice, one for bank account and one for credit card.
The Solicitors tried the "too vague" defence on the credit card (£120). And the charges are "services" claim on the bank account (£450). The judge sent me a letter for the credit card and ask me to send full claim details, which I did, the hearing for this was due in april. The hearing for the bank account was in march.
I then get a letter from lloyds solictors, with the claim reference for the bank account, settling the credit card ! Now for a while I wasn't too on the ball, I looked at the reference and my calendar and thought fine, they have settled the one for march. Then it dawned on me what they had done. Luckily I did not send a letter to the court quoting the incorrect reference and saying it was settled because if I had, that would have been the bank account claim finished with, without me getting the money!
So I sent a letter to the solicitors explaining the mistake on the reference and asking them to confirm they were settling the credit card. Anyway time went on I my partner went to court (I am doing this for him), he only find sthat they has sent a letter to the judge saying they had settled the case !! So he explained the position to the judge that they had settled the wrong one and the judge said that he would write to the bank explaining this and has set and a new date for it to be heard in april. So on this day, the bank didn't turn up, they got away with it with their letter claiming they had settled.
So what do we think here ? This has been a very convenient mistake for the bank, causing me to waste more time and If I hadn't been on the ball I would have told the bank that the wrong case was settled (for the higher value).
So I wondering what to do next. I am waiting for a reply to SC&M, to confirm which case they are settling. The case that they have obviously actually paid the money is due to be heard on the 10th of April. For which I sent my court bundle. I sent my letter to SC&M on the 19th of March asking them to confirm which case they are settling.
I was thinking of leaving it a few more days and then writing to the court to say I haven't heard from SC&M and maybe ask the court to set a deadline or something for them to respond so that I know where I am. Any Advice ?
Re: Watch out when you have two cases Lloyds v Superbadger
Hi
My partner now tells me today that the bank has paid £500 pounds into his bank account for our other claim. So both claims have been settled at last! Wow so we actually did it !
I have been reading up on Gary's thread (see link below) re asking the court for costs. I think we have some good grounds for this now. So will be using his template letter etc.
So will try this and let you know how we get on. I also remember reading that I should submit our court claim numbers + that we have won somewhere on the site, but I forget where, so will do when I find it again...
One question I have. We didn't apply for interest in the claims. I thought that it was fair not to at the time, before Lloyds gave us the complete run around! Should I ask the Judge to consider awarding us interest too as part of the application for costs ?
