    Default New A&L Account

    Hi all,
    I am currently in the process of reclaiming all my bank charges from Barclaysicon Bank, and opened a parachute accounticon with A&L as suggested by Martin Lewis. I went for the Premier Direct account and opened it in Feb 2007.
    In the process of switching accounts I have incurred several charges (one from a bounced cheque that I was using to pay my court fee for Barclays!)
    Anyway, I telephoned A&L and polietly suggested they might want to refund the charges as we both know they are unlawful and that I would win if I went to court, and they didn't want that. I was told a supervisor would write to me with their decision.
    I duely received a letter stating that they were "unable to refund on this occasion."
    I then spoke to my brother who has just had his Barclays claim settled and he told me that the banks are now changing their T&C's and calling these "fees/charges" etc, "penalties" or "fines" as aparently this is making the charges lawful. Has anyone else heard this and is it true,
    Also do you suggest I go ahead and follow the same process and formally request the charges back?

    Hi Claret74.

    If I gave you a bag of humbugs and told you that it was a bunch of flowers, would you eat them or put them in water?
    It doesn't matter what the bank calls them, they are still penalty charges and therefore unlawful.
    Add them to your schedule of charges and claim them all back, just the same.

    That's a standard A&L letter, i received three of them, before I sent my letter and they gave in - bear with it, follow the instructions on CAGicon and you WILL WIN!
