    Sent my DPA letter and £10 cheque by recorded delivery today. Always found A&L to be a building society playing at being a bank. No flexibility on charges whatsoever. Will wait and see what they charged me!

    Received my dpa bank statements today from A&L. Charges for the time I had my account come to £477. They did charge me £25 a month for having an authorised overdrafticon, can these charges be claimed back. I'm thinking they can't is that correct?

    Had a letter back today 21-07-06 from my letter dated 10th July asking for my £477 in charges back.

    They have refused on these lines:-

    "The OFT has commented that they consider the level of late payment charges to be unfair, however they were actually refering to late payment fees on credit card payments which are quite distinct from a bank's charges on current account's.

    As yet the OFT has not yet entered into any discussions with the banking industry regarding current accounts. However should that position change in the future then A & L will participate as appropriate.

    Given the above I cannot accept you have been unfairly charged as you suggest. I regret, therefore, that I am unable to agree to your request for a refund of charges on this occasion."

    Hi there, had one of these myself a few days ago. Had a read through some threads from last week and apparently this is a standard reply - usually unsigned! Mine was from S Murray - whoever the hell he/she is! Looking at advice given, this is the stage where you send your letter before actionicon... People were claiming before the OFT statement and this is just to add weight to the claim. The fact remains that these 'fees' are still unlawful so we can go ahead and get them back. Think they do this just to scare you off at the first hurdle Good luck with this - looks like we'll be on a similar schedule with them so let me know how you get on...
