    Default mastercard123 v natwest

    hi again,

    i had a mastercard which went over the credit limit by well over 340 pounds. Natwesticon settle at 219 pounds as a gesture of a good will. when they closed my bank account without notice i found out that they only refunded 95 pounds when i complaint their care customer service. they paid the reminder of 124 pounds within one hour( however this was discovered after one week, as i didn;t have access to my on line statement, and they told me this was alarge amount of money whioch nmed to be verified by a manger blaf blah blah..) which they did. they said they offer was Full and finalicon settlement however, it misses about 120 pounds worth of charges which was not refunded. can i still reclaim the 120 pounds remaining ( i haven't signed anything, thye just told me that if they haven't heard anything from me this will be consider as acceepted it will be considered as a full and final settlement) .
    can i still reclaim the remimder at the small claimicon court even though i haven't send a rejection letter due to a lack of fund ?
    any help will be appreciated as tis ammount wasclearly associated with my default ? thank you .

    was the money refunded? did you accept settlement? if the latter is yes then the answer is no but if not then the answer is yes

    So in other words, if you accepted it in Full and finalicon settlement then no you cant claim. But if you didnt accept it in full and final settlement, then you can go ahead and make a claim for the difference. Fendy xxxx

    i haven't received any letter from natrwest to agreee as a final and full settlelment nopr i did send them a letter acknowledging this offer as i was shortr of cash to send it recorded delivery . so do i have to send this a letter as a partial offer or do i start court proceeding or do i do nothing? sorry but it is rather confusing for me ? lol

    i would send a letter saying that you accept the payment as a partial one but that you will persue the remaining balance of your outstanding claim & give them 14 days to respond before your will begin court action.

    what concerns me more here is the closure of the A/C, more than one bank have been fined for taking 'retalitory' action against a claimer.
    this appears to me to be the case here on what you write.

    p'haps it might be an idea to include in the letter a threat to complain to the relevent authority if the refund is not met in full & pronto.
