Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Well i have had a reply from the woolwich, i just made a formal complaint over the phone and they are looking in to it. with all my other cards and banks i have gone the formal way with the SAR. But woolwich took my complaint there and then and are looking into it. The lady on the phone said i would recieve an offer before the 4 weeks were up. So lets see, i did ask her to make note on my file that i would not be taking anything less than the full amount or i would be proceeding to court. i doubt this will make a difference and they will still offer my half. But i am going all the way,
I had £600.oo in charges last year alone. so just add up the other 5 years and no doubt should be in for a few quid. (lets hope)
Receiving an offer isn't fruitless, it's an extra piece of documentary evidence to add to your court bundle (that you will never get to present but will have to compile anyway!).
When I think of all the financial scraps my family couls have avoided had our money been available to us over the last 6 years, it really is hard not to be rather bitter with the fat cats but hey ho, what goes around ...I am tempering my frustration bylooking at it as if I had just stuck all the money under the matress - no interest but it time to buy a new bed!
Well the Woolwich have said they would reply by the 3rd or April and still not heard anything. thought i would phone them and see what the current state of play was. The lovely man on the phone have said that they are just telling all customers that they will hear by the specified dates on there letter. so there is still hope, if i do not have a letter on my door step by tuesday. guess i will be on to the next step
For me, the 40 days is up next week however the letter I had back (standard "we're investigating" blurb) stated their aim to resolve by today (30th March).
It would be nice if I got my statements in tomorrow's mail but I'm not holding my breathe.
I do however have the Brach of DPA letter written up to print off come day 40!
Well i have had an offer from woolwich, my total charges are 1895 and they have offered me 1421. what do we think about that, tempted to take it, but then again i want my full amount back. am i jsut being greedy????/
how is wanting back whats rightfully yours greedy?
I'd also point out that refusing that offer and issuing a small claims court claim will allow you to add statutory interest of 8%pa to that £1895, that can add up to quite a bit, especially on older charges! added over 20% to the total I was claiming . . . . . . .
Did You Send Them A Letter Thanks But No Thanks Or Did You Take It As Part Payment And Say You Were Persuing The Rest Of The Amount? Will They Withdraw The First Offer? If I Only Take As Part Payment
Well Tempted As I Am To Take The Offer, I Think I Will Take This All The Way, As You Rightly Said, The Money Is Mine By Right And With The 8% On Top Then That Is An Added Bonus.
How Long Did It Take You To Get Your Full Amound Mumofthree?? If At The End Of April It Is Decieded That 12 Is A Fair Price, Will This Affect My Claim?
Thanks For Your Help Mumofthree, Always Makes You Feel Better When You Have Got A Few Opinions On A Subject. Guess It Is Too Easy To Just Take What Is On Offer. But I Feel The Banks Have Got Away With This For Far To Long. And We Do Have A Right To Our Own Money
Hi just received my first offer of over 10k but will have to reject it as it falls 8k short of what i want with the interest feel awful cos could really do with the money!
Dont loose sight of the finishing line, it ain't over till the fat lady sings! She'll sound even better with the full amount (plus some) sitting in your bank for you to enjoy the summer with!
