Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Having recently had my claim against Lloyds settled in full, I'm now going after Abbey. Sent my SAR on 15th March by Recorded delivery - checked online and it says delivered on 16th March. So, just sit back and wait for the statements now!

33 days..... still no sound of hundreds of envelopes landing on my doormat...... Seven days to go Shabbey!!!
This is the first time I've dealt with Abbey and I'm assuming this is pretty much par for the course... does anyone have any suggestions about how to get them to speed up?? (Apart from rockets, fireworks and explosives etc....)

I'm afraid Abbey are the slowest and take everything to the wire. The only thing that will speed them up is court action...and the lady who deals with the statements certainly does not live up to her name.....Pam Speed...she's only got 2...slow and stop.

squeezyland is a little known village (you won't find it on a map) near Ellesmere Port
Well, in that case, we're practically neighbours, I'm just round the corner from Arrowe park hospital. At this point I suppose I should say 'small world isn't it' but cant bring myself top say it because its soooooo corny

Spoke to Sheena Small (01908 344061) at the copy statement unit at Abbey (thanks to Elizabeth in a post elsewhere on the site for this info!). They've got not record of my SAR even though it's been signed for. She was very helpful though and is going to chase them up - I mentioned that they've only got 4 days left in which to comply with SAR or they'll be in breach of DPA, at which point I will send them a final letter giving them 7 further days in which to comply before applying for a court order. She replied that the court order wouldn't help get the statements any quicker as this would give them 21 more days in which to respond.

Yes, it will still take a while to get your statements, but it will cost them, and it will prove that you will not be messed around in the future.
As I posted a few minutes ago (on another thread), the longer you wait, the more interest will accrue, and at 8%, tax free, it all adds up and is better than any savings account I know.
Statements finally arrived yesterday - totted up the charges and sending Prelim letter today....
Quick question..... my account with Abbey has been dormant for about a year with a negative balance which is just about equal to my claim. Can I request that my claim is settled by cheque rather than into the account? I'm really loath to have to use the cash to pay back an overdraft with them when it's their charges that have caused the overdraft and in turn, left me with no option but to go into debt elsewhere to pay the bills etc... that were bounced after they'd applied charges and taken all my wages.
Any advice? I'm not really looking for a moralistic argument here, just a 'where do I stand' thing!?

As much as I'd like to give you a moral argument railing against the evils of Big Business...............I think you'll struggle to get them to pay you a cheque while the account is still open. If it was closed then a cheque is the answer, but if you were in their situation......what would you do?
Answer........effectively , you'd pay the money back to yourself.
Sorry:o

Charley, I agree......except, they did pay me with a cheque, and my a/c was open and well o/d.
I think it depends on how they feel on the day. I bet though, if you specifically asked for a cheque, they'll credit your account, just for the sake of it.

Reading the above and having informed choices so your confident and know what suits you is why I have added the information, so you can ask questions till the waiting time for a reply to the letter is up.
