Hi there. I am absolutely skint, as always !! and this morning the post brought a statement from the Nat West. I am £109 overdrawn, due to 3 bank charges last month. Basically I didnt get the money into the account on time. I have since cancelled the direct debits. I cannot afford to pay this amount and am absolutely awful at speaking to officials on the phone. I end up agreeing to all sorts !!! Is there an email address for someone at the Nat West that I can make an arrangement to pay this off and hopefully bargain to remove these charges?
Any help appreciated?
Chances are with a claim this small Nasty West will cave in on your prelim letter or lba letter, as its not a huge amount. Get claiming back what is yours. Go for it, dont be frightened, they are just people. They are not better than you in any way, exactly the same as you. Be assertive. Go get your money. Its yours. Not theirs. Let them know you know your rights. Be brave, its yours. Fendy x

Just claim. If they have put charges on there making it a much bigger amount you owe them, then by rights that money is yours. Just claim. And once you start your claim, if the account you have, i.e. debt is in dispute you can write to them telling them so and they cant then apply any more charges to it, etc. etc until the whole dispute has been sorted out and finished. Good Luck. Get your claim going, and once youve calculated your charges and start the process to claim back, write to them, telling them this debt is in dispute so it buys you time until your claim gets settled. Brilliant. Thanks for your encouragement. The account is £108.90 overdrawn due to £109 unpaid d/d charges. I have cancelled the direct debits now and this account is otherwise inactive. have written to Nat West today (local branch), realitively informal letter at this point,(copied and pasted below) I am hoping that as these charges are the only three ever on this account and were only placed there in February that this matter can be sorted out quickly. However if I do not get anywhere with this letter in 14 days I will send a copy of the first letter template and start giving them timescales. I will keep you posted, Thank you
Last month I cancelled the two direct debits from my account, although not in time and I have gained three bank charges, totaling £109.
I have researched the bank charges thoroughly and after the announcement from the OFT on the 5th April I would like to point out to you that these charges are unlawful at Common Law, Statute and recent consumer regulations. If you say that they are not then will you please demonstrate this by letting me have a full Breakdown of the costs to which you have been put by as a result of my breaches, in order to reassure me that your penalties really do reflect your costs.
I would ask please that you refund my account with the £109.

Go get em. Well done. Its just the beginning. But Im sure for this relatively small ish amount, they will cave by lba stage. If not, pursue it, anything it costs you to get it back, you can claim back. Dont let them get away with treating you like a number. You are a person, and the money is yours, not theirs. Take Care. In the post this morning I got a letter from Nat West telling me they have been trying to contact me by telephone over the last few days. They want me to call them. If I have a cheque book and highline/service card I should return them. (I have a solo card, so dont know if they want me to return it?)
I was going to check my balance via the hole in the wall today to see if they had refunded the three charges, but I think that if I do my card will get swallowed.
Do I respond to this letter?

That's excellent. I will bump the message tomorrow evening if I haven't heard from Nattie, brilliant to know there are so many out there with expert knowledge. I presume that this letter I receievd this morning is in reply to the one I sent to my local branch earlier this week. They say they have tried to phone me, not sure about that though, have been at work this week but there has always been someone home, and also I have got BT 1571/1471.

Don't return you card. ring them and complain! Tell them they charged you when you had already cancelled the direct debit and its there fault and not yours. Asking for your card and cheque book is a scare tactic. They asked me for mine and i told them i'd hand it in at my local branch and never did.. they never chased it up because they haven't got a clue what ther doing. Good luck!!

Thanks for the advice, appreciate knowing there are others that can help. I cancelled the direct debits too late, so I do not really have a valid argument to present to them. I am not concerned if they close my account, I don't use it regularly. I am just in the situation where I am ovrdrawn with them to the tune of £109, purely because of them charging me three times for unpaid direct debits. Under normal circumstances my tact would be to pay £15/20 into the account each week to clear the account, however I don't want to do that if there is a chance they will refund the charges,

Thats ok. If thats the case, then i would say 2 pay the £109 back so u can't get charged anymore, coz i didnt n now im having to start a 2nd claim for over £400. Paying them that won't effect u claiming it back, it just saves hassle later on! Trust me! Then if u haven't already start ur claiming process of sending your letters to them.xx

You say they asked you for your cards etc to be returned? Did you attempt to use your card at all? I want to try to get a mini statement/balance but wonder if the machine will retain my card

Hmmmm.. iv never tried to use my card so not sure. But them asking for your card and cheque book just because you've gone over your limit is strange. I have been over my limit a few times and they have never asked me for my card or cheque book before, only when i asked for my charges returned is when they asked for my cheque book and card.. which makes me think its a scare tactic. So try not to stress about it 2 much. If u want a balance on your account or a statement from the last month, go in to the bank and ask them to print you one off. Don't give them your card to do it, just your bank details (sort, acc numb). I have done this many times when i have forgotten my card. I went in to the bank the other day and ordered 3 months worth of bank statements and my accounts 600 o.d. I went in and told them there solicitors (cobbetts) had asked for them, and because they knew i knew what i was on about (even tho they didn't have a clue what i was on about and they had never even heard of cobbetts) they ordered me them, and i didn't have to pay.They wont ask you for your card back, they may say to you "do you know your account is in arrears?".. if they say anything like that, just tell them that your account is in dispute and you need the info to deal with it. Don't be scared of them.. there in the wrong, not u!

Help needed please!
I've just received all my statements from NWB for one of my accounts and a quick total of abusive charges brings up £3,800. Obviously I have to write back with a reasonable figure. Is there any figure per unpaid item (not their obscene £35) that they tend to accept?
Sorry if this has been answered umpteen times before.. I'm a newbie here!
Start a new thread in the Natwest section, top left on top of natwest forum click new thread give it a title such as manorhey vs natwest and start the thread. The answer by the way is unless they tell you how much it costs then a reasonable amount to claim is...........all of it
