Just a quick question for you all...
Has anyone claimed compensation under section 13 of the Data Protection Act due to "damage suffered as a result of a contravention of the Data Protection Act"? Any of you who complained to The Information Commissioner's Office about Barclaycard hiding behind the microfiche argument should know what I am on about! I am putting together my initial claim to send to Barclaycard and would like some advice on this matter PLEASE!!!
HSBC:
Data Protection Act S.A.R - (Subject Access Request) sent 23/5
Prelim request sent 18/8 - ignored
LBA sent 6/9 - offer made, but it's not good enough!
Full offer received 19/9/06

40 day deadline is up on 4/7
Information Commissioner had to intervene, got most of the statements I asked for but some still missing.

Thanks noomill, that looked very complicated! I complained to the Information Commisioners Office about Barclaycud and eventually they supplied what I had asked for (but only 6 years back from their compliance date rather than from when I initially submitted my SAR) so maybe I will leave this bit. I was only going to do it to because I could! Thanks for the info.
