    Standard letter recieved from A&L denouncing my claim, and stating that the OFT investigation applied to CC charges etc..

    Question 1: Can I send my lbaicon today, or do I need to give them the full 14 days grace?

    Question 2: I take it at this point when I send my schedule again I don't add the interesticon still.

    Question 3: Can I ammend the LBA and Schedule now adding my latest charges?

    Many thanks in advance, I couldn't find specific answers to these queries so apologies if they've been asked before (which I expect they have, many times!)

    q1. How quickly did they reply? - I would personally wait the 14 days
    q2. Yes dont add the interest
    q3. Yes ammend LBA with recently added charges, mentioning that this is an updated schedule of charges.

    To try and speed things up a little you might want to add the line :
    I am writing to give you one final opportunity to make full payment of £xxxxxx Alternatively we can settle this matter in court, which I'm sure you are aware that every previous case of this kind has resulted in the full amount being returned to the claimant.

    Or along those lines, I know it has worked in some cases previously.

    Thats great thanks Chookie - they sent within 10 days, so I'll send of all my stuff on Tuesday, that will be the full 14 days. Thanks for claifying the other points..

    Today (25/05/07) - MCOL Filed, Schedule (x2) sent to MCOL Court Manager.

    Charges: £1362.00
    interesticon: £56.23 (8%)
    Court Fee: £120.00

    Total Claim: £1538.23

    And so it begins...

    10/06/07 - Recieved Acknowlegement of Service from both MCOL and Wragge & Co.

    11/06/07 - Recieved Full and finalicon settlement offer of £308, apparently this is the difference between the £12 charge as reccomended by OFT, and their original charges. This offer is way off even that, you'd have thought being a financial institution they'd at least be able to use a calculator..

    12/06/07 - Rejection letter sent, including an opportunity for them to forward my total claim in settlement before court.

    Looks like this ones going all the way too.

    Good luck There are plenty of us way ahead of you who've received court dates, so you'll get plenty of advice along the way.

    Hi all,

    Well my case was stayed as soon as the OFT case was announced, but then today I got a letter from the court saying the hearing has been restored, and my new date is 29/10/2007.

    I've been searching for what I should be doing now, I submitted my bundle 14 days before my last date so they have everything - are the going to settle, or am I going to court do you think?

    Crickey - you are priviliged!

    Do you know why it was stayed and then restored?

    If you read my thread in successes then you will see that the "negotiations " normally happen just before the case - or as in wiliams case on the doorstep. They have not appeared at a full hearing yet as far as I know.

    Play the game and dont try and nudge again as it probably wont do any good.

    It seems that you are well prepared.

    I am a bit confused / concerned - it was stayed pending the outcome of the test case, there is no reason on the 'Notice of Restored Hearing' I have been sent, only that it has been given a new date.

    I really hope A&L do settle, I've had a letter from them about a month ago saying they were applying for a stay even though Newbury county courticon had already informed me this was happening, and then about a week ago I had the same letter from Wragge and Co.

    I shall keep my fingers crossed..

    if you put newbury cc in as advanced search you will see there is a hearing there on 3rd Oct for others about lifting stays. Keep an eye on that.


    Zootscoot - any comment of the case mentioned in the allen thread on here? Carlisle v clydesdale?
