    Default me v Citi Cards

    Hi All

    I'm now starting my own thread on this (previously have some posts on Chrissy v Citi cards)

    Story so far:

    Had all statements so sent Prelim letter on 22 February.
    Letter received (dated 28 Feb) from Citi - saying the £12 charge is fair blah blah blah
    lbaicon sent 7 March 2007

    I've now received the following letter (dated 16 March):

    "Thank you for taking the time to write to me about the refund of default charges to your Citi Card account.

    I understand that you have contacted us previously about this matter, which we will now look into again for you. To allow me to review your request I may be required to obtain copies of your statements. Unfortunately, if this is the case, it may take between three and six weeks as they are retrieved from our archives, however if you have previously requested these statements as a Data Subject access requesticon, I may be able to get this information sooner.

    Once I have the information and assessed your request, I will confirm in wiriting the outcome........."

    Hmm, I enclosed copy statements and schedule fo charges with my prelim letter. I think I'll send them again to Mark Clibbens to save him having to request them from archiving !!!

    Hi munchkin,
    I have had exactly the same letter today from Mark Clibbens. It just proves how automated this whole system is. Obviously they are hoping that some of us will get fed up with all the delaying tactics etc that they use. Am with you on this one - will be interesting to see the next step they take. Keep in touch.

    i have just sent S.A.R. for my husband to Citi Cards and had a form come back asking for more information reguarding his account number address and proof of idendity is this normal for Citi Cards?

    Hi Sonic,
    It's standard procedure, and Citi are well within their rights to ask for further ID......they have to be spot on when dealing with Data Access Requests. Send the requested proof of ID with a gentle reminder that their 40 day time limit started from your first letter!

    Sent letter off to Mark Clibbens on 19 March as follows:

    Dear Mr Clibbens

    Re: Citi Credit Card, Account Number: XXXX XXXX XXXX XXXX
    Your ref: Case XXXX

    Thank you for your letter dated 16 March 2007.

    I note that you plan to review my request for the repayment of penalty charges applied to my account as per my previous letters and that you may be required to obtain copies of my statements in order to do so. I advise you that I enclosed copies of these statements with my letter dated 22 February 2007. I now enclose further copies of the statements for your reference to save you the trouble of trying to locate the previous copies or request copies from archiving.

    As I have now provided you with all the information you require, I hereby give you a further seven days in which to review my claim. I believe that this target is sufficient for a large company such as yours with dedicated staff and departments.

    I look forward for a full response to this letter within the stated time limit, otherwise I will commence court proceedings to reclaim my money.

    This means that I plan to start an MCOL on 28 March. What did you do Chrissy?

    Hi I had an interesting situation with Citi on the 12th Jan 2007 was court day Citi was not there so lost by default. eventually 5th feb got an extract for payment from the court so sent it to CITI Sunderland office ( the place where the court papers were sent) nothing heard so had a sheriff officer take over and he sent recorded delivery a copy of the extract and amount due etc.Again no reply so had the sheriff officer send a new set of papers to Citi's Dundee office. At the same time I received a letter from CITI's London Office saying I owed money on one of my cards I wrote back stating the story of the suit and saying I would start paying the monthly payments when the late payments were removed and I received the money the court said I was due. To day I received a letter from Perth Sheriff Court saying that there was a new case on the 13th April because CITI say they never received the papers. Quite interesting as I am going into the court tomorrow with all the papers including the recorded delivery signatures etc. I want to find out why a firm like CITI can get away with all this wasting of time etc. Will let you know what happens

    To continue went to small claims dept of Perth sheriff court with all my papers and found out that Citi said they had not received any of the summons etc. and they were in their rights to have a new case which is now 13th. April. Well I had with me the recorded delivery receipts also had the names of those who signed for them si it will be interesting to see what the judge will make of it all because the first letter (RDicon) was in Nov.2006 and then all the others as they came due. But will have to wait until the case

    Their registered office in England is the Reading address,although they have responded from Manchester in the bulk of litigations.
    Failing to respond to court papers is something that Mr.Smiths office are very famous for......and where judgements and warrants are obtained by the claimants they are in almost all cases challenged by Citi who will seek hearings to have them set asideicon.
    They claim that the cases they are currently defending (100)...has stretched their defence capabilities and they also claim amongst other things their famous Irish victory.
    One thing strikes me as odd..........Barclaysicon and RBSicon manage in most cases to comply with court submissions but on a few occasions have not done so and have been penalised.Citi with all its U.S. backing evade much of the same treatments by their continual tactics which seem to have the Courts confused.

    Unsurprisingly I've had no response to my last letter enclosing further copies of statements to save Mr Clibbens a job and protracted timescale in retrieving copies so am about to file an MCOL.

    However the address for Citi on their correspondance is a PO Box number in Salford and I gather you're not supposed to use PO Box Nos for MCOL. Any idea which is the best address to use for Citi on MCOL?

    Reading is their registerred offices, which you should use when filing your MCOL.

    Manchester is the credit card businesses base.

    Can I just add that my sister had problems with Citi saying they hadn't received letters. The SARicon was sent to the Reading address as when she called Salford to ask who to send it to was told by customer service that they were't allowed to say. Told them in no uncertain terms this was total rubbish. Sent to Reading and they failed to comply so a complaint was sent to ICO who found against Citi. This Smith man used the excuse it had gone to the wrong address but it didn't wash. Anyway she has taken her penalties refund to fosicon as too busy to get tied up with their court shenanigans, although will file if FOS has no success.
    Have you reported BS to the Law Society?

    I mentioned previously about the problems I was having with CITI and a new case has been arranged for 13th. April. I sent a copy of the article about citi being famous for saying they had not received the paperwork. I put a note saying the judge should see it. So lets hope it works will let you know in due course

    Got a response from Mark Clibbens yesterday as follows:

    "Thank you for your letter dated 19th March...

    To review your request fairly I would need to see copies of all of your account statments, so the correct charge amount can be assessed. So far you have sent only a small number of statements. If you would like to send copies of the others to me then I will be happy to review these for you. Alternatively I will be requesting the information needed through our archive which may take a short time."

    Hmm - the statements I sent him were the ones with charges on. Does he actually need them all? Perhaps he is just being very diligent and helpful and wants to make sure that I haven't missed any??!!

    I have all of my statements from July 2003 but have destroyed previous ones in an attempt to keep my filing down. So even if I send all the others I suspect that he will still say he needs to request the others from archiving which will 'take a little while'.

    I have completed the MCOL form but not submitted it yet as I haven't got the £120 court fee at the mo (I have already paid £130 in court fees this week for two other claims and have another 2 on hold 'cos the court fee would be £370!!) I need to get a payout really before I can continue with my other claims which is very annoying as it's delaying all the timescales...

    Anyway to get back to the point, does anyone have ideas for a suitable response to the above letter?
