    Default Babyonlyne vs A & L

hi everyone!! new to the site and a feeling a bit wobbled by A&L.

OHHH what i could say about Alliance and Leicester!!!

I (unlike most) had all my statements and in the last 2-3 yrs of being with a&l they've inflicted nearly £900 of charges on me. I sent off the letter using moneysaving expert because i hadnt known about this site till today. they replied to my first letter saying the charges were reasonable and the unfair charges were actually referring to credit cards which are disticnt from bank charges. blah blah blah i'me sure most people recieved that letter.

sent them a second letter demanding repayment or i would file a claim against them for the amount in charges plus 8% interest. letter was sent to the 9/3/07 and again i had an unsuccessful letter dated 15 march. i said they had to reply in 7 working days or else. they have replied with:

"I have now had the opportunity to review why the charges were raised and have all considered your coments. i can now confirm that the charges have been applied correctly in line with the T & Csof your account and as such i regret i am unable to agree a refund on this occasion. i appreciate you may be disappointed with this decision but please be assured our charges are in line with those made bt by other finacial organisations."

thats the main part of the letter. yes i am disappointed. has anyone recieved a letter like this. what was the next step you took.

and of all the nerve of this gold digging money hungry bank they charged m3 £59 for paying a cheque qhich in turn took me under £3 over my £50 limit.

because of this i seriously feel like grabbing them by the balls!. has anyone ever recieved or claimed charges interest and compensation? i am tempted to add a bit of compensation to it because my son and i had to eat beans toast and sausaged for a whole week becasue that was all i could afford when they decided to slap on approx £400 in charges in a month. i lost a lot of weight becasue i was stressed and had to ask my sister to pay about half of the charges of god only knows what i would have been. back then i had an overdrafticon for £200 and have since reduced it. has anyone ever done this (add compensation). is it too late for me to do so. and if i cant what's my next course of action with regards to the letter they sent this morning. moneysavingexpert says this the time where you claim using moneyclaim online as its faster.

oh one more question (probably too late to change it) but i charged interest at 8% from the dat incurred for each charge recieved and not the total amount charged from the intial charge date.

eg charge icurred on 12/12/05 £50
    interest £5
    charge incurred 01/01/06 £34
    interest £4

    and not

    charges total £850
    interest incurred £200

i'm hoping the top is right because thats what ive done, at least thats what i understood from all the reading i'd done. could anyone confirm

    thanks for all the help

    1. You can't claim compensation in Small Claims.

    2. You need a schedule of charges. Use the Simple S/S here:

    http://www.consumeractiongroup.co.uk...eadsheets.html

See here for a visual guide:
    http://www.consumeractiongroup.co.uk...html#post50088

Overwrite the existing examples type of charge, amount and date.

The days since and 8% will be calculated automatically

Save it and print out as your schedule of charges.

hi, thanks for the info micheal browne, very helpful

whilst reading i noticed that there seemed to be some contraversey over allowing the banks the full 14 days or filing a court claim once they've responded.

just to be on the safe side i've waited evn though i requested a result in 7 working days.

only question is when sending a copy of charges plus 8% interesticon do i attach the original charges table or do i update it as interest would have gone up slightly.

i intend on making the claim on 23 march.

also it appears some people get successful results so rapidly are A & L doing ini-mini? or is it just my luck

i'm scared they may put in a defence even though i know that it doesnt mean they will attend and often settle up a few or so before.

any advice to calm my nerves

Best advice anyone can give, babyonlyne, is to spend a good few hours reading some of the threads on here. You will find you're not alone, which is comforting in itself.

You'll also see how the whole A&L claim thing pans out - what to expect (although you're practically at the finishing line now!). This should have the desired nerve-calming effect.

Feel free to ask for more support, as and when needed. 8)

    hi, thanks
i recieved an acknowledgement of service this morning....god why is this taking so long???
is it me or is A&L conspiring against me....

some ppl seem to have gotten through the process without a sweat... or is it that A&L are trying to smarten up or are they just selecting a few to tackle....either way why me

i need every blooody penny cos im a student & single parent....know its been only a couple months but it feels like for ever!

wont be surprised if they put in a defence...

oh are they allowed to still apply charges to your account whilst you are going through the process of reclaiming

since i started they've slapped on 5/6 more charges on me
i disputed the first and they refunded the second and monday they piled on a couple....surely that cant be right? i know T&C's with the banks hasnt changed but why do they insist on adding further charges when they know they shouldn't and you're reclaiming. am i allowed to reclaim these charges a the same time or will i have to go through it all again?

Who was the acknowledgement od service from?/ A&L or the court?
If its the court I reckon they have ticked the "DEFENDING" box.
if you have not received this you will in a couple of days
