Hi to all claimers. I am about to send off my SAR. I already have statements going back to April 2005, so I only need April 2002 to March 2005. I have read a few threads and found that Barclaycard are a bit lapse in sending out earlier statements. Do you eventually get the statements back???? Also can you claim back the £12 charges which are the reduced ones since Sept 2006???
As my SAR deadline is up on 27.04.07, and I have received diddly squatt from them, is it worthwhile doing a little nudging letter to them so that they are aware that I haven't gone away?
In my SAR I requested statements from April 2002 to March 2004. I have received today statements from June 2004 to present day, and was told that all previous statements are stored on microfilm and take more time to search and reproduce. These will likely to be sent within the next 6 weeks or so. And they banked my money, but say in the letter they will not charge me!! And the SAR does not cover the microfilm statements.

I have just drafed up a letter to go to B'card. I would be grateful if someone could have a look at it and tell me if it is ok or whether I should add anything or take anything out.
I am writing with regard to the information sent to me by you dated 25th April 2007. I am disappointed that you totally disregarded my letter dated 17th March 2007 of which I specifically requested a complete set of statements from April 2002 to March 2004. Instead you sent me statements from June 2004 to present time, and stated that statements prior to this date are stored on microfilm and that I will be receiving them within the next six weeks. You also went on to state that you do not consider that the microfilm statements fall within the scope of the Data Protection Act 1998. May I take this time to remind you of the visit by the Information Commissioner’s Office to inspect your system in operation, and that they concluded that the microfiche system used by yourselves is a relevant filing system for the purposes of the Act and that the information stored is personal data and should be supplied as part of my SAR. I am grateful that you are willing to supply me with the information as a gesture of goodwill, but am puzzled as to why you have cashed the cheque for £10.00 I sent you.
I am willing to give you a further 14 days to comply with my SAR dated 17th March 2007 and if I have not received the information that I requested by 15th May, 2007, I will be left with no alternative but to commence a county court action under sections 7, 13 and 15(2) of the Data Protection Act 1998, naming you as Data Controller.

their time runs out tomorrow ,so theyll be getting a letter sent to them on tuesday! cheeky devils! in the SARs they did give me its already nearly cleared the balance so im waiting with baited breathe!
At last I have now got all of my statements. I have put all of the charges on to a spreadsheet and am now ready to do prelim letter. I have had a look at the contact address thread but I am totally confused as to where to send my prelim. Please could someone post the address on my thread.

Just received a letter offering me the difference between what OFT say (£12 per charge) and what they have imposed on my account. My claim was for £636 and they have offered me £216.00 and they say that they are going to credit my account with it. What do I do now? Can I ask for a cheque?

well if you push them they prob will pay the lot.im going for it.they have just put a credit on my card and havent said a word about it or what its for! but with Capital One they did the same ,refunded the difference,and im taking them to court.and ive read people have been given their money before court date so its worth a try...
