    Default Limitations Act (advice needed)

    Hello everyone on the Barclaycard threads,
    I used to have an account with Barclaycard between 1996 and 1999. Certainly a while back, and I would like to get old statements sent. I have scanned the microfiche threads and it can not believe the hassle they have given people.

    If they had the statements i would be happy to proceed and try and claim under the limitations act, but here is where i need some advice.

    Based on barlcays recent attitudes, if i were to send a SARicon what would the chances be that I actually got my statements from them?

    If they have the data they really have no choice but to comply and from what I've seen a sniff of a non-compliance claim is all it takes to get them to part with the info if they've been reluctant up to that point.

    I don't actually know how long they keep records for but I'd be surprised if they didn't have at least some of 96-99.

    Be aware that if you're claiming for stuff that would normally be excluded by the limitation acticon they may well put up more of a fight. Please also note that Barclaysicon claim they did not introduce charges until 2001, so if they're telling the truth you might not have anything to claim.

    Hi, I can confirm that Barclaycard didn't introduce charges until 2001. I was forever missing payments before that date with little consequence other than my card being blocked in a few cases and interesticon being racked up.

    Barclaycard used to actually advertise the fact they did not impose charges. When they removed the £10? annual account fee they introduced these charges.

    It annoyed me because the first I heard of it was when £45 was sprung on me on Oct 2001 !!! Very annoyed as I always paid in full, just that payment sometimes slipped the due date by 1 day which like I said was never an issue other than getting a "telling off" type statement and min payment upped to £10 in months prior to 10/2001.

    To cut to the chase - digging up all your 1999 and earlier statements would be an exercise in futility.

    This is not so.

    Charges were made back in June 1999, according to my info.

    I've heard discussion on this before where peeps thought charges were only introduced later.

    I have a state't which shows an Out of Order fee of £20. Oops, forgot to mention the date of June 1999 !

    That's the earliest chg I've noticed on my own state's.

    Barclaycard charged £5 for overlimit / late payments up until the late 80s.

    1989 I think.
