    Question Lloyds have paid a goodwill amount into my account without asking me to accept.

    Hi All,

    Help please

    Lloydsicon sent me letter at the end of fEBruARY OFFERING ME A £750 goodwill paymenticon on the agreement that it was in settlement of my complaint, they have credited my account with this directly even though they didn't ask / give me the option to accept or reject it. What do I do?

    Do I have to write to them to formally reject this amount and give it back to them in order to proceed to get the full £2000+ I am claiming? They didn't mark the letter "without prejudiceicon" so I assume they might use it any defence. Their phone number is permanently engaged so it's impossible to speak to them

    Do I need to start the process again with another 2 demand letters with all the amounts changed to reflect this payment? What should I do?

    Hi Ian..my fellow SouthYorkshireman.

    I had the same 750 goodwill paymenticon. There is a template rejection letter in the Bank Templates section of this site. Send them back that.

    13th Nov 2006 - Preliminary Letter delivered to branch

    30th Nov 2006 - LBA - deliverered to branch

    30th Nov 2006 - Standard 'we are looking into this letter'

    15th Dec 2006 - SAR delivered to branch to demand six years statements (currently pursuing 5 years)

    19th Dec 2006 -750 Pounds offered as settlement. Accepted as PART settlement 20th Dec 2006.

    Filed with MCOL online - Notice of issue from 17th Jan 2007.

    The £750 is as it says a good will gesture, write to them saying you accept it as part payment and will persue the rest through the normal channels. I got mine just before christmas which was a very nice gesture thank you.

    Hi Ian,

    This has been pretty much a standard response from Lloydsicon.

    There are 3 different options for you to consider.

    You can reject this offer out of hand and ask them to remove it from your account.
    You can accept it as part settlement in the understanding that you are continuing your claim for the full amount.
    You can accept it as a final settlement.

    No need to revisit your claim, but if you wish to continue your claim for the full amount you must send a letter stating you are rejecting this payment as Full and finalicon settlement. As Hudu has pointed out there are now letter templates you can use, and i would strongly advise you use 1 of the letters offered in the link below.

    As far as i know, Lloyds have never attempted to reclaim this money even if it is rejected out of hand, but leave it alone, and do not spend it until your claim is settled.

    If you decide to continue with your claim (which hopefully you will!) then you can now proceed to issue your claim through the courts, having recieved an unsatisfactory answer to your lbaicon.

    You can reject this offer out of hand and ask them to remove it from your account. :grin:
    This option is not advisable though - the offer was purely a goodwill gestureicon and came without conditions. You've a duty to mitigate your loss and the court may consider it obstructive if you refuse it completely.

    Accept is on the clear understanding that its a part-payment only and that you are pursuing the remainder. See the letter which pondy has kindly linked for you.

    Hi Ian /Gary,

    Yes i agree with Gary H - that is not an option i would choose. I should have mentioned that. :o

    Personally, i accepted the Gesture of goodwill paymenticon as part settlement only, and asked them to remove it from my account within 7 days, if they did not agree with my conditional acceptance. They responded with a letter stating that they would not be making any attempt to reclaim the gesture of goodwillicon.

    I hope Gary's input, and this post, guide you in the right direction.
