    Angry PJGODMAN V ABBEY 'Overdraft/Default' hassle' help

    Guys,

    Abbeyicon have already written to me once before demanding their overdrafticon back, and I responded to them and Triton Square, explaining the account is in disputeicon.

    I have received a letter today dated the 12th!!! demanding my cards and cheque books back within 7 days or they will take further action which will cost me £45 and threatened me with a default and a debt collectionicon agency!

    What shall I do?

    ive had very simalar problems. my acccount is £900 OD i have sent a SARicon asking for my data. received 12months and they promised to send me the rest. In the meantime they have transferred my account to DRMS (a collection agency) I spoke to them today and in all fairness to DRMS they were quite helpful. I agreed to pay back £50 per month.

    obvoiusly it is not good that my account is now with them but once I get all my statments from them I am going to insist that when I make my claim that they remove any defaults as it is the charges that have caused it. the 12 months data that i have is for more than the £900 that i owe them.

    If you ring the number on the letter, which I assume is from milton keyenes and try to arrange to make monthly payments to them,they may agree to that.

    Im at aqicon stage, which needs to be submitted by the 27th March.

    How do I get these people off my back, without them defaulting me, because Abbeyicon clearly dont communicate between offices, I sent in a letter to Triton House at the same time as Milton Keynes stating the account is in disputeicon.

    They owe me over £2700, I owe then £2500.

    It all seems very petty of them. It looks like they have taken the gloves off in retribution for taking them to court. Did you have a parachute accounticon set up?

    If you are quite sure of your figures than I would up the ante.
    return the aqicon including our proposed disclosure directions.
    Serve them them an immediate s.10 Data Protection Act notice and seek an emergency interim injunction to prevent a default pending the outcome of the case.consumer forums

    Is their threatened default a formal notice or merely an informal threat.
    I would also begin a complaint to the Ombudsmanicon about their general conduct of your account which you can say breaches the Banking Codeicon.

    Actually Bankfodder it seems that they will carry out their threat, this happened to me just recently i phoned them quoting the Banking Codeicon at them and all i got was we'll make a note of it. i then faxed allen betts head of unsecured debts with a letter stating the same, this was done after i was informed the default notice had been applied it still had no effect, I just posted some comments about this in my thread http://www.consumeractiongroup.co.uk...onc-abbey.html perhaps you would care to take a look at it as this seems to be an escalating problem and might be a change in tactics on abbeys behalf.
    Although i'm not particularly bothered about the default a lot of people will be.

    I suspect this is their last snipeicon, as they have no other ammunition to hit people with.
    I may be wrong but the Ombusman that appeared on Watchdog did say that banks indulging in this sort of behaviour were out of order.
