Hello everybody, I am new to CAG and the Egg forum and I am hoping you can help me with my shocking story
2 years ago I migrated and was oblivious to my husbands credit card debt. Ater a while his strange behavour led to his confession. He had an egg account which he had used time and time again and kept it a secret and hoping that since we no longer lived in the UK he did not need to confess, well lo and behold we have had to come back to the UK. I really need to sort out this problem, but we did not leave a holding address (obviously) and I need to buy a house/ car/ usual things and cannot possibly as I am too scared of the CCJ.
I believe, from the sketchy information I have, that the debt was sold to Capquest and they got a judgement by default and a CCJ was placed on my husband's credit file. I also believe that almost half the debt is made up of charges added whilst the account was in default. I am trying to persuade my husband that we need to get a copy of his credit file, however, I am fearful that by doing this, Capquest will be alerted to our presence in the UK. Whilst I realise that to sort this out I will eventually have to make contact with them, I am not in the financial position to offer a settlement at this time.
I would be grateful if anybody could advise on what I should do next apart from emigrate again

well i think you after seeing if your file has been defaulted by capquest or Egg...?
well doing that will not alert them.
it is simple to do
just use the experian website & for £2 [if you find the right link] it will be sent to you, or you can do it on-line now for free, but watchout, unless you cancel the membership, they will bill your card.
that should atleast give you the info to start with.
as for claiming back the charges, if its not past 6 yrs old, then you need to weight up if the charges out do the balance & the chasing that may happen.

Thank you for your reply. I have no idea which one defaulted us but will certainly look at the on-line thingy.
The debt is approximately half charges. If I persued to have the charges removed, would they accept a settlement on the remaining amount and would this be enough to apply to have the CCJ removed?

Capital One - S.A.R - (Subject Access Request) issued.
Goldfish - S.A.R - (Subject Access Request) issued.
Tesco - SAR issued.
(A) Remove CCJ and restore credit rating -- CCJ was put on after due process, cannot see it being removed. Public record of CCJ will be retained by Experian et al for 6 years.
(B) Contacting Capquest, waking up the sleeping dog -- the benefit would be to put an end to the past, while the drawback is the barking dog.
(C) Charges reclaim -- your right to reclaim will remain open and available to you any time for 6 years after unlawful charges were applied. May seems an advantage to reclaim your own money, but rather a moot point as the refund will only halve a debt which at present you are fully not repaying.
