Default Court proceedings submitted- but got this letter from Abbey

    Hi,

My Abbeyicon claim is ticking along nicely, I filed an online court claim 16 days ago which has been acknowledged by Abbey.

however I got this letter from them yesterday, and i'm not sure what i'm obliged to send:

    Dear Mr xxxx,

    Claim number xxxx
    Yourselve -V-Abbey

We are in the process of reviewing this claim and preparing our response. A defence will be filled in due course.

In the meantime, we note that you have claimed the sum of £xxxx in respect of charges that you say have benn made to your Abbey account. We appriciate that you have previously forwarded details of your claim to the internal Complaints department however we do not have access to this information. To expidite the processing of your claim could you therefore please provide us with:

    your account number

1,details of how you calculated your claim, by date and amount of each charge claimed

2,details of how the interesticon is calculated, showing how interest is calculated by reference to each charge

3,As you will appriciate, you will need to produce evidence to the Court regarding these amounts. and this information should have been appended to the claim for when you filled your claim (ITS WAS)

    blah blah......kind regards

    Abbey
Sounds to me like they have lost my paper work!

This is a standard letter that everyone gets.

Provided you have proof of posting of previous scheduals, then you have no obligation to do anything. If however, you wish to maintain an image of fairness (for the courts benefit) then send another copy, take it into your branch (if convenient) and get them to stamp it and send it (keep a stamped copy yourself)

I assume you have sent the curt a copy of the schedual, if so then you need do nothing.

    Louis

I'm tempted not to send it again as they should not be so incompetent.

I'd submit the list of charges again, in the probably hypothetical event of you ever entering a court room you can show that you've been fair to them. As for the interesticon calculations - they're a bank, they ought to be able to hazard a guess at how you did that

If in doubt read the FAQs

If still in doubt - ask!

I'm in the same boat Phil. I rang the number in the top right hand corner of your letter and got through to Inga. I told her about the letter and she asked me to email over a copy of the schedule of charges (inga.kirklman@Abbeyicon.com) . I also told her she was quite famous in my little world, she responded saying that she kept meaning to have a look at CAGicon (her words not mine) to see what people thought of her. I told her everyone thought she was a friendly and astute lady (for an ozzy) ha ha
