Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I could really do with some reassurance. I've sent my preliminary letter to A & L for charges of £59 (not much I know - but still money they shouldn't have taken)
Anyway, the 14 day deadline ran out yesterday and I haven't heard anything at all. I've got my letter before action all ready to go, but I'm petrified of sending it.
From reading other threads it looks likely that they'll close my account eventually. Unfortunately I've been making full use of the £2000 overdraft so it looks like I need to find another account with this facility pretty sharpish (any ideas?).
Anyway, I'm just worried about what following this course of action will do to my credit rating.
Please advise me - I really don't know if it's worth all of this even if it is my money I'm claiming back.

Don't be scared - turn the tables at long last and get control back on your side.
They may close the account, although I would guess for this low figure being claimed that they will simply pay up and tell you 'not to be a naughty customer again, future charges will stand... bla bla bla"
No harm in looking for a new account though....

Absolutely nothing, whatsoever.

I would suggest sending all mail to them by recorded delivery, at least you know when they actually got it then and it doesn't cost much!
The reply to my initial letter was over 2 weeks but the reply to my court threatening letter came after just over 1 week - only saying they are investigating of course...
Do go for it!!! My charges were only £75 but that's not the point, it will make you feel much better just by taking control. Good Luck, Rich
Hi rich - fancy making a new thread with your details so far - every little helps when it comes to showing people just how many others are taking action...?
End of hijack, sorry bluekp !!

Well, I'm ashamed to admit that I still haven't got up the nerve to send my second letter.
I did receive a reply to my first letter the day after my first post saying the usual "sorry you're not happy - we'll investigate blah blah blah".
I think for my own piece of mind I'm going to have to open a parachute account with enough overdraft available that I don't drop myself in it if they close my account. Once that's done I'll post my second letter.
Also, my fiance has decided that he wants to chase Lloyds TSB for his charges so as there's no overdraft on that account we're going for it full steam ahead - data request letter is printed and ready to go!
bluekp - it's your call, and you have to be happy in what you are doing, so no problem there. Please do start a new thread though, as your case could hijack this thread.
John

jonni2bad - was just wondering how am I hijacking my own thread?
Anyway, my latest update is as follows:
I didn't get a chance to send my second letter following on from their "investigating" letter, as this morning I received another letter from them saying that their charges were lawful and still stand blah blah blah, but on this occasion they are refunding 100% of my charges as "a goodwill gesture".
Either way, a result for me and I've now got the confidence to take on Lloyds TSB (which I will start a new thread for).
Oh and I have filled in the survey in case anyone was wondering.
Thank you to everyone for their advice and support x
When the Liberals and Conservatives were in opposition they both agreed that banks should pay back high bank charges to customers. Nothing seems to of happened since they came into power as a coalition. PPI insurance has been sorted now they should turn their attention to bank charges and help customers get exorbitant charges refunded.
