    Default Johnny4 Vs Barclaycard (They're spouting all sorts about microfilm)

    Hi

    Just got a reply to my SARicon today. They have sent statements going back to 2004 however have said it will take them 7 more weeks because the rest is on microfilm.

    This isn't my fault and I was planning on informing them that the 40 day DPA deadline still applies.

    They have said microfilm is not covered by the DPA? (This is news to me) however they will still provide the info as a goodwill gestureicon.(I'm suspicious)

    They have also said that the information commissioner is aware of this. I think a complaint might well be in order.

    I would appreciate help from anyone who has an idea what is the best thing to do.

    The microfiche argument is rubbish. The Information Commissioner's Office is indeed aware of the problem and have said that microfiche is a relevant filing system so they must comply with the DPA. The next step is to look here:

    I would also make a complaint to the ICO. Barclaysicon have recently announced record profits of £14 billion so you would think they could employ enough staff to ensure that they comply with their customer's requests and stop breaking the law.

    If I may quote directly from a letter I recieved this week from the ICO in relation to a complaint about Woolwich (part of Sharkley's Bank)

    "Following a recent OFT decision about "penalty charges" we are aware that the number of individuals making SARs to financial institutions has significantly increased. However, clearly these financial institutions are still required to comply with SARs within the statutory 40 calendar days"
