My daughter received a parking fine from euro car parks at her college, she did not have change for machine could not find attendant, put her student card in windscreen to let attendant know she is a student and attending college. Went back to pay for ticket later, and found they had already issued fine,according to the ticket they allowed her 10 mins.
Not very helpful, college did not want to know although they agree to student fines of £30 upwards. They did suggest she spoke to attendant following day tried three times still no attendant to be found.
We appealed straight away but have not heard anything she is worrying about fine increasing while we wait for reply. Can they legally enforce this fine and add more money she cannot afford. we would welcome any suggestions.
Please don't worry about this! It's just another example of a private parking company attempting to extort money from somebody who, they assume, does not have the knowledge to defend it. Advise your daughter not to pay the ticket. When she receives a reminder from Euro car parks, it will threaten all sorts, including increased costs and probably court action. At that point she should write a letter stating that, although she is the registered keeper of the car, she is aware that, under contract law any action to recover costs should be taken against the driver, as only the driver, not the registered keeper would have been party to any alleged contract. She should ask them for full details of any contract that was struck and also to provide details of the driver so she can pass the ticket on to them. As this falls under civil law, the onus is on them to prove that a contract was made and who it was made with. With any luck, that should be the end of it.
Hi thanks for advise, but have already appealed as the driver, but she could not locate a attendant for help, she never intended not to pay, this is a student car park, i think fines here are a rip off .
What makes it worse is that there are not enough car parking spaces at the college, she has to park at another car park quite often at £4.50, as she had to, the day before.
Then take the line of defence that no valid contract was entered into, as she obviously wasn't aware of the consequences, which is an illegal penalty in any case. This is a better strategy anyway IMO. If they say her appeal has failed, ignore them, as they have no authority to judge 'appeals': it isn't a real fine, it's an invoice from a cowboy company trying on a [problem].
