    Default Going to start making a claim!

    I got charged £25 for going -£7 for a few hours, and then as I tried to resolve this out I got charged 2x £25 fees. So on that I decided to put a claim in, looking at all my other charges, adding to £175. I have all my statements so I checked over them today! So I have written out the letter, using the template, and will send it of tomorrow, and will keep this post up to date.

    Any feedback on this would be great cheers, I just hope I have a good claim

    Hi glennk, welcome.

    Any claim is a good claim and all the charges you've listed are reclaimable!

    If you haven't already done so, I would suggest you have a good read round the forum to see what to expect during a claim from A&L. Also have a delve into the FAQs, just so you're well clear on what you are doing.

    Finally, have you opened a parachute accounticon? As things stand at the moment, A&L are closing the accounts of anyone who makes a claim against them, and while things may change in the future we currently advise claimants to have a parachuteicon 'just in case'. Obviously it needn't be used if things do change, but at this date in time there is no guarantee of this happening, and you wouldn't want to be inconvenienced if you were suddenly deprived of your banking facilities.

    Hi, yeah I have had a good read around the posts that other people have made. Just going to take it one step at at time.

    I am not sure what you mean by parachute accounticon. I have with drawn all my funds from the account just incase they take money and there is no refund. but yes i would be able to manage with out this account!

    The term 'parachuteicon' is used to denote safety - as in you wouldn't jump from a plane without one!

    It just means a spare. It is recommended you open an account at another bank.

    All part of the tested procedure on the CAGicon site, recommended whichever bank you're claiming from, but as A&L openly stated last year that they will definitely close all claimants' accounts, it's a necessity for us.

    After 2 weeks I didnt hear a thing so i sent on the 2nd letter. another 2 weeks and still aint heard anything!

    I am thinking that I sent it to A&L Main (head) bank, should I have sent it to My local branch?

    Aslo dose me living in northern ireland affect my rights?

    I sent all my correspondence to bootle - have received standard bogg off replies - but some people have received no correspondence untill court claim.Make sure everything is sent recorded. Reference Ireland I am bumping your question up the queue - but try putting in as a search and see what comes up?

    Just recived the following letter.... hope some one can advise me on what to do next....

    Dear mr kinning

    Thank you for your enquiry that we refund the fees you have paid on your current account. These fees form part of the term & conditions of your account and were generated because payments you made caused your account to go over your agreed overdrafticon limit or where no overdraft facilities were agreed, took your account into an overdrawn state.

    As you may be aware of the Office of fair trading (OFT) is currently reviewing the issue of current account charges. It is our understanding that they have suggested that there may be some similarities between the default charges on credit cards and similar charges applied to current accounts, however, it recognises that the application of the general principals set out in 2006 to the banking industry is not straight forward and that a more detailed examination is needed in relation to bank charges.

    Default charges may apply to current accounts when items are presented for payment whilst the account is in excess of its overdraft limit and are returned unpaid (bounced) and a fee is charged. We do not believe that the term applies to other types of fee.

    Having reviewed the particular circumstances of your case and taking into account the ongoing OFT review we can find no evidence of any unpaid item charges having been debited to your account. We believe that all charges made to your account are in accordance with the terms and conditionsicon, of which you have been given a copy. There fore I am unable to settle your claim.

    I appreciate you may be disappointed with my response and if you wish, you can refer your complaint to the Financial Ombudsmanicon Service within 6 months of the date of this letter. I am enclosing a leaflet that explains more about the service and how to contact them.

    yes for me i moved to the small claims via mcol.but from what people are saying i could have gone straight to my local county courticon and filled in the n1.no matter i am on top at this stage and counting down the 14 days to defend.:grin:

    My next step would be to go to the small claims court. though I am confused by the fact that the courts differ here in northern ireland, and I dont know what form(S) to fill in.

    very little has happened fromt he last letters I sent of to the bank. I did recive a letter from them though, basicaly saying that they are stopping communication with me and if i have any futher problems to go to the Ombudsmanicon.

    Should I write to them? is there and can some one point me in the direction of peopl/ companys who deal with you banking fee's!
