Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I've posted before but couldnt work out how to update my thread.
I've been helping my friend who lives at the other side of the country reclaim his charges.
We did step one and two, then filed with the court. The claim was acknowledged on the 2nd of March. He's just called me to say a cheque for the full amount has landed on his doorstep. £1046!!!!
No letter to say they will defend I don't think.
He is delighted, and we will donate here as soon as he cashes it.
He says the letter states that they will be contacting him to discuss his account as he "doesn't agree with the terms and conditions"!
A couple of questions?
I know I need to let the court know, but couldn't see anything on moneyclaim website tolet me do this?
Also it looks like A&L have paid and included the £80 court fee also, as total charges + interest was approx £960? I don't understand why they have done that? Any info gratefull received.
And also a very big THANK YOU to this site and everyone who has been so helpful.

When you sent the letter before action, you state that as a result of non-compliance, you will be seeking the 8% interest per annum and the court fees in full.
If you look through the paperwork, you should notice that you included those amounts when you submitted the claim to the courts.

I think ....
Hiya, thanks for your reply. I though including court fees meant the A&L pay them if we won the case. As they have settled out of court I thought we could ask for a refund from the court itself?

I believe the ball is in their court. If they only want to pay the charges back, they would settle before you submitted the court papers, however as they decided not to play ball, as stated in the letters, you would have then passed the 8% interest and the court fees onto them and added it to the total claim amount.
It does seem that they enjoy paying interest and court fees
