I was hoping for some advice.
I am currently pursuing some more bnk charges ith HSBC. However, with these, i also haave adebt of around 3 grand which is taken direct from my wages at source.
However, this debt was part of a managed loan account and is made up of a lot of charges.
I will reclaim this and hopefully get the CCJ removed once I have sorted out my charges.
Does anyone know if the chargees will come straight off the debt, even though i have specifically requested i don't want this?
Alsoo, once i started reclaiming the charges should the account have not been in dispute? I believe so,therefore they should not have been able to take a monthly payment out of my salary.
Attachment of earnings is only something that happens a long way down the line of a claim
Ami I correct in assuming that you did not reply to the claim forms and then not comply with the CCJ order
If so, that left HSBC to do pretty much what they wanted at the time
Not entirely sure what the question is here, surely you will reclaim the charges and get them directly back and let the attachment of earnings run its course until the debt is clear
If when they got a CCJ against you, it wasn't complied with the answer is yes, they were fully entitled to go for an attachment of earnings
If you are getting your charges back anyway, and paying off what you owe at the same time, then there really shouldn't be a problem
It is very difficult (if not impossible) to get an attachment of eanrings overturned, HSBC won't agree to it, which would mean another trip to court and possibly more costs
