    Default Achuaran v Woolwich

    Ball now rolling. Confirmation of receipt of SARicon received yesterday, although no mention in the letter about supplying details of charges. Not worried, as this seems to be the norm. Fingers crossed time.

    You and I are at the same stage (within 24 hours), so it'll be interesting to compare response times/letters. Good Luck, though it doesn't seem luck should or will play a big part in it if the banks stay good and keepdoing the smart thing and settling in full at the 11th hour.

    Please supply me with a complete list of transactions and charges relating to my banking history with your organisation. Alternatively, a complete set of statements for that period will be acceptable.

    You requsted this in your letter so they will supply the info or it will be a case of non-compliance.

    Waiting game for now so read up as much as you can so you are one step ahead of the game, good luck.

    Reply from Peter Townsend today - is this still normal practice?

    We refer to your letter of 24th Feb, which was passed to this department for comment due to your request for certain information under the terms of the DPA.
    As requested, a schedule of charges is in course of preparation and this will be sent to you shortly by the Woolwich; there will be no charge for this service. As the Bank is providing this information on a complimentary basis, your payment is returned herewith.
    As regards your mention of "manual invervention", the DPA does not oblige the Bank to comment about internal policies and procedures. Furthermore, in the context of managing day to day transactions arising from out of order accounts, the Bank does not hold the information you have requested in a form that would be covered by the DPA. Whilst aggregated information is retained for statiscal purposes, this would not constitute "personal dataicon" under the DPA and therefore would not be covered by a s.7 DPA Subject access requesticon. For the avoidance of doubt, the fact that we do not generally record information in a way that is caught by the provisions of the DPA, is in no way an admission that there was no such manual intervention.

    Am I worrying about nothing?

    I just got this same letter response from Andrew Miskell at Barclaysicon, Radbroke Hall. Thanks to joiningthis site, I can confidently read it as blah,blah,blah and will wait for either my statements or the 40 day time limit
