Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
hi i had a bailiff call last week for unpaid council tax in my name, i did as advised and did not let him in, he returned to his car and noted down the registration number of my car. the question is can they take the car without walking possession the car is not mine my girlfriend bought it but it is registered to me for insurance purposes as i could not insure it in my name if i was not the registered keeper. i informed the bailiff that the car was not mine at the time.
Today i have recieved a letter saying that unless i pay in full within 7 days they will be sending a van to remove my belongings. i have been paying the council directly each month as much as i can afford be it £10 or £100 i telephoned the bailiff company and told them that i am paying the council directly and asked them to return the debt to them as i would not let them into the home. i was basically told to pay or the bailiff would return and remove goods.
so
1 can they legally take the car as the debt is in my name only
2 is there anything else they can do and why turn up with a van without walking possession
Get n touch with the council and also if you are on benefit income support etc they can deduct a maximum of£2.90 per week from your benefits. this will get the bailiffs off your backs!!
