    Default Mel v Abbey

    I issued all the usual letters and lbaicon to Abbeyicon in respect of my charges (fortunately had all the statements to hand so at least I wasn't subjected to the delaying tactics that they seem to have used with so many here). I received the usual letters about how we are looking into your complaint and we're sorry that you'ave had to complain (along with so many others) and we'll get back to you in 4 weeks etc , then another letter saying that it was all taking longer than they thought and they couldn't comply with their own complaints procedure. Therefore after LBA , I filed my claim - £1855 in total. Today, I've just had notice that they intend to defend in full. I have not received any further letters from them. My question to those further ahead than me with the Shabbey - what defence have they put up to claims that for charges only and at what point do they finally give up and pay up - if indeed they do. I assume that the "defence" is some sort of 50% offer - if so is everyone refusing and carrying on?

    hi mel, the choice is yours to go to court or accept the offer, most people are going all the way. You may get an offer along the way(theres a very good chance you will) but with Abbeyicon you just never know.

    I'm sure there are many threads with their defence on but you can have a look at mine. i'll post the link for you.

    A few answers for you

    1. Standard defence is this - 'yourclaim is based upon the assumption that you should not pay any charges at all....blah blah blah' 'Abbeyicon deny each and every allegation made against them' 'we have sent T&Qs thousands of times......'

    It is not worth the paper its written on, seems to be standard to every case.


    2. Abbey will settle at any point up to, and including, the court date. There doesn't appear to be any set proceedure, it looks like random to me.

    3. The 50% offer. Well, some accept it as part payment, some reject it totally, but I have not seen (on this site) anyone accept it as Full and finalicon settlement.

    Thanks for that. Have every intention of going all the way - think Abbeyicon truly are shambolic. Any problem I've ever had with them - it has always been a case of delaying tactics. I could paper the walls with the letters saying "we're really sorry that you've had to write to us." and copies of that infamous complaints procedure !
