    Default had ppi on a loan

    with a+l the misses ended up in hospital and i had to stop working to look after her

    applyed for the insurance and was regected

    genworth financal

    would not pay as the illnes was the same as she had had 12 month before

    that was there conclustion

    the also payed another claim diffrent account

    now we have had a ccj against us

    she had suffered with a break down and becouls she had deppretion be fore thats there reason for not paying the insurance claim


    how can i sort this

    also the mentel health group sent them letters and phoned them that the ill ness was not the same and she was in 2nd ery health care not primery health care

    help plz

    they want 4 grand of us

    Do you recall disclosing this condition when you took out the PPIicon, are they likely to be able to prove this was not disclosed when taking out PPI?

    In the first instance, I would write to them and explain your predicament - show them what income / expenditure you have and try to agree a workable repayment schedule. As for the PPI, if it was no use from the start - you have been missold the policy (claiming WILL be a long process). May be worth considering using an agency to handle your PPI claim if you do not have the energy to fight them yourself (they will take typically a quarter of what they can claim back on your behalf for the priviledge).

    wen taken out she only told them a bout depretion

    then 2 years down the line she had a mental break down and they classed it as the same condition

    SEEING THINGS HEARING VOICES THINKING WERE TRYING TO KILL HER PHONING THE POLICE AND AMBULANE servises wanting to go shopping naked hospitalised for 15 days no on 2 fluoxitine a day and 2 risperidal at night to try to stop her imagining things

    is that bad i think so

    DCG, well it doesn't sound like depression to me, There is a huge difference between depression and what your wife is experiencing now, which I would say was more a psychotic episode. I wouldn't let this one go at all. there is absoulutely no conection between the two

    Has she been diagnosed? As for the meds, how is she on the risperidal, has it relieved any of the syptoms?

    yes and no she still having bad days and i took me 7 mounth to get her to start going out again shopping was a big problem to many people around all crying wen they wernt

    So sorry to hear of your predicament.

    Can you please clarify the following points to me.

    Did they make the loan available on the condition that you took out the PPIicon?

    Did a&l discuss the terms and conditionsicon of the loan relating to any previous illnesses and conditions that you or your wife were suffering?

    Was the policy sold fit for your purpose.?

    Did you have any other policies or life cover?

    Secondly,

    Did they pay money to you regarding your wife's illness.

    You state that the mental health team have written to A&L regarding the current illness that I is not the same as the first.

    I do agree that there is a bit difference. Depression is one condition and psychosis is another altogether.

    It a bit like claiming for a broken leg for one claim and then refusing you because you had to have a knee replacement of the same leg. You are still not able to work.
    Personally if your wife was hospitalized, I would ask the consultant to give you a letter clarifing your wife condition and the major differences between the two. Also ask you GP for a letter.

    The more you get the more you can throw at them.

    I am no expert. My opinion is my own.

    I feel there are a few points

    1. They sold you a ppi when you have told them about your wife's depression. I presumme that they made a payment for this condition and are now refusing to pay out on the 2nd more serious condition.

    2. They will insist that you were told that the ppi on the loan was optional and you agreed. they will claim that you were not mis-sold this ppi as you knew you had it and claimed on it for the 1st illness. It boils down as to whether you want to threaten legal action and you can claim that they insisted that you take ppi with the loan. There has to be good reasons why you think that it was mis-sold.

    3. They are refusing to pay out for the second more serious illness, which does not sound like depression but another mental health problem which is different to depression.

    4.You will have to look at the terms and conditionsicon of the policy, to see if they clump mental health illness under one group. ie mental health problems.

    5. If they don't then I would pursue the matter and insist that they pay out for the present condition. You need to have the diagnosis explained to the insurance company by a Doctor in writing to have more clout.

    Maybe approach Citizens advice Bureau to see if they can give you any assistance or advice to help you.

    so we have a ccj

    as there insurance didnt pay do we counter claim or do we file a claim against a+l or genwerth finance

    we dont have 4 grand to pay it

    Sorry I understand what you mean now.

    If A&L sold you the PPIicon, which was worthless to you, you approach them for the mis-selling.start with a 1st letter asking for repayment of the ppi and the interesticon you where charged. If you need help with this ask. You have to have a good reason why you think it was mis-sold to you, Was it a condition of the loan that you had to take it out.
