I am wishing to start proceedings to reclaim many years worth of over charges and indeed charges caused by charges.
In the past I have reclaimed fees on fees as I was charged for going overdrawn because of a charge for going over drawn the previous month which lasted many months which accumulated at the beginning it was a single charge, the following month It was double that until it became over a hundred a month and peeked at around £250 in one month for one charge.
Having set a deal to repay the overdraft to Abbey I had originally set the amount at £70 per month which was affordable at the beginning under the agreement that once finance became less available I would be able to reduce the amount, this was denied and the bank threatened to close the account should I not pay.
The amount of stress this has caused as it also led to me having to leave my council flat as rent became unobtainable and am now in process of trying regain a grip on these finances with help from friends.
I was directed to yourselves and wish to claim back my money.
All the best with your claim spegmore, Abbey can be difficult so be ready for a long and bumpy ride. Read as much as you can in the FAQs and on the other threads on this forum and you'll be fine.
They can't refuse to accept your payment no matter what the amount is as long as you can prove that that is all you can afford, look at it this way If they tried to take you to court for the money you owe them and you showed the judge the evidence of what you could pay he would just throw it out of court. The Nat West several years ago tried it with me on some mortgage arrears, i had made an agreement with them to repay them £50 a month which they accepted, five months later they took me to court to repossess the house, i showed the judge the bank statements and he just turned to their solicitor and asked why they had brought it to court and threw it out.
