    Question Help needed Karish v Abbey

    Hi,Can anyone help me with this question. I have an overdrafticon on my Abbey account and have opened a parachute accounticon and moved all my money to my new account. The money that I am claiming will cover the overdraft facility and give me a surplus when it my case is concluded. Abbey have written to me stating that I need to continue to pay money into the account in order to maintain the overdraft facility. I remember reading that you could write back and tell them that the account was in dispute if they sent correspondence like this. Can anyone tell me where to find this template?Thanks for your help.Karish

    Karish, I had the exact same from a Mr Betts (debt managementicon or something like that). No doubt there is a template somewhere, but I just made mine up and replied to him :
    Thank you for your letter (Reference A) about the overdrafticon on my account. As requested, I have re-established payment in of a regular amount.
    However, it is not clear from your letter what amount would be required to maintain the overdraft limit at its current level. I would just ask you to take into account when deciding on this that the account is currently the subject of Court action by me in relation to your default charges which I contend are a penalty and therefore unenforceable. The account balance is therefore in dispute.
    Reference B provides a cross reference to those at Abbeyicon at Milton Keynes dealing with my Court action.

    Note that I didn't say how much (actually it was £100pm) or when it would restart (about 3 weeks later). I didn't want to give him any specifics to come back to me about. That was around Christmas and it's been all quiet since - he certainly never replied. Regards, Mad Nick
