    Hi

    Sent off preliminary approach letters to Intelligent Finance for my account (£419) and my husband's account (£88) on Monday and today (Saturday) received the following in the post:

    Account number XXXXXXX

    I refer to your recent request for us to review the charges that have been applied to your current account.
    I write to advise you on this occaision after careful investigation, the charges were applied correctly to your account and therefore will remain.
    I appreciate the comments made in your letter but would refer to our terms and conditionsicon page 20 section A.9 Charges and Expenses. On opening your account you would have agreed to our terms and conditionsicon. You would have also been provided with our interesticon rates and charges booklet listing details of our charges.

    Have they missed the point?
    Do I proceed directly to lbaicon?

    It's not so much that they have missed the point, more a case of they haven't got a clue what the point is. I would continue with your timetable, and send the lbaicon on the due date.

    Hi,

    I've just had a similar responce from IF and am now in the process of doing the court claim, but it says it will get refused as it is outside England and Wales.

    Can somebody please tell me what to do with this one...... please!

    It's a bit daunting all this court business but I'm feeling confident. I am claiming charges of about £450 from IF and Halifaxicon so should be worth it in the long run!

    I got the same response from IF, unsurprisingly!

    My claim has been issued against Halifaxicon plc, at the registered office given on all correspondance from IF.

    Nationwide - £80.00 refund agreed 01/06/06
    Halifax Current Account - £132.75 refunded 07/06/06 (I won without asking! See this thread)
    Intelligent Finance - £941.23 (including interest and court costs) refunded in full 09/06/06
    smile - £255 refunded 30/06/06
    GE Money - £195 refunded 01/07/06
    NatWest - £4,801.15 (including interest and costs) refunded by cheque 14/02/07
    Capital One - £40 refunded 06/06/06 - another £16 refunded 21/07/06
    Barclaycard - £72 refunded 03/07/06
    American Express - £300 refunded 05/07/06


    Halifax MasterCard - DPA request sent 19/02/07
    Co-operative Bank - DPA request sent 19/02/07


    Total charges refunded (inc. Interest) - £6,831.98!

    Interesting. Do you have a copy of the terms and conditionsicon? A contract normally states that if there is a dispute this should be settled in the court of X country. Sometimes it will only say that the terms are governed by the laws of X country, for example England and Wales.

    I also bank with IF so I will try and see if I can find my copy of the T&C.

    Intelligent Finance is a division of Halifaxicon. It's not a separate legal entity. Therefore you make your claim to the West Yorkshireicon address.

    By the way, I have sent my lbaicon for approx. £600 and IF have until 7 June to respond. I have been sent a "holding" later saying they are unhappy to hear about my complaint and are looking into it....

    Default Intelligent Finance bank and card services

    Hi
    I am due to issue moneyclaim tomorrow for IF and their card services. Could anyone advise on the correct address in light of some discussion on this thread about not being able to issue summons in Scotland, and therefore having to use the Halifaxicon address?

    Hope I haven't made a boo.....

    I've already issued a claim through moneyclaim to the Halifaxicon for my Halifax account, using the address P O Box 548, Leeds. LS1 1WU as this is where my letters came from.

    Can I issue a second claim to the Halifax even tho it's Intelligent Finance and use the Trinity Road address or would this look daft??

    I have heard that you can use the Livingstone address if you complete form N1 from the small claims court - would that be better??

    Sorry polar b, I wouldn't know where to find my T&C's...... not very good I know!

    I have also recieved the same response, and am due to send the second letter on friday.

    Should i send the letter to the same address again - as they will already have a record of my claim, or is there a better contact?

    I sent mine to the contact address that has been made sticky at the top of this forum.

    Also in the second letter it mentions not recieving a reply - can i just substitute a suitable sentence saying that i am unhappy with their response so far?
