Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I started claiming bank charges (£1700) from Barclays in June 2006.I have followed the steps without delay and I still have not received any money from the bank (they did offer me £650 as a gesture of goodwill). The hearing date is 3rd April and I am busy putting together the BUNDLE for the court and the bank. It is a bit nerve wrecking but I know that we have reached the point of no return. Is there anybody out there who could advice me about the bundle? Any suggestions would be appreciated.
Edit
Thanks for your help Bookworm.
I have started to compile my specific bundle. Do I need to send copies of all the bank statements that contain punitive charges? What do you mean by latest schedule of charges? Can I update the schedule or should I use the one sent off months ago?
Thanks again,
Edit
Latest schedule: You should have sent the bank as part of your letters a schedule showing type of charge, when levied, amount levied. If you have done it on Excel s/sheet, it would be adding interest on a daily basis, so the running total would be different form what it was when you first filed, therefore, you should send the most updated version. When they call to settle, make sure you have your Excel s/sheet in front of you to make sure you settle for the current amount. ;-)
Apologies to people who I was in the process of helping, I may be gone some time.
I'm really sorry to hijack your thread but I was hoping to have a quick 'word' with Bookie about my bundle for my LW claim.
Bookie hunni (u can tell I'm after summat!) I've almost finished my bundle (ie changing it to suit for a claim against a catalogue) and I'm just finishing my statement of evidence ... there are a few bits I could do with adive on whether to remove/replace etc ... any chance I could mail them to you to look over or wotever ... I know u don't allow pm's but is there any other way of contacting you with these ... I need to post Weds/Thurs latest ... thanks muchly & apologies again to edit for the hijack!
The Barclays sent me a letter offering me an out of court settlement. When I phoned to accept the offer I was told that the amount might need to be split between my husband and myself because the account was a joint account. My husband is an undischarged bankrupt. When he was declared bankrupt I became liable for all the joint debts. We owed money to Barclays and to HSBC. I could not settle the debt instantly but offered to pay a minimum amount and started to claim back the bank charges in order to settle the account. In the meantime Barclays sold the debt to a collection company. I am not 100% sure whether I am still liable for the debt towards Barclays. I fear that they will pay me half of the amount and keep the other half. I need to reply to their offer today and I also need to notify the court. Does anybody know what to do in a tricky situation like this?
