Hi everyone
sorry to of not been on here for a while but there was nothing to report. as said last Month court date set for March 26th they now wish to settle. but they have asked me to look at my charges again because have seem to of added some of these twice and i have done this and yes i have. i now have the correct figure but can i still claim the interest due to being overdrawn. plus can i claim the 8% and the time it has taken to put every thing to gether I.E. Posting copying and anything else
many thanks for your help
It's only my opinion, but at this stage then everything is open for negotiation and it's up to you to get the very best deal you can. If you don't ask then you won't get , but I'd make sure you're on firm ground with your your proposals, so no asking for contractual interest after claiming 8% all along.
If you have put interest in your claim then you can argue for that too, at whatever rate you put it in there.
Re costs if the claim has been allocated to SCC then no i don't believe you can legitimately argue for costs, but theres no harm in trying.
If it hasn't been allocated or it has been allocated to fast track then yes claim for costs, 6.75 per letter or 9.25 per hour for your time. you cannot i believe claim both time and cost for the same letter.

Thank you both for your comments, as i had put in my claim at the start was interest due to the charges +the 8% i will only do this. +the gwg i recieved of £555 which came off the then figure of my balance of £1.113 in which my overdraft at this time was £700 £413 was taken in charges and interest so only£142 was returned. having put this in my claim i will try to get this back on settlement. I will post when this as been agreed with Abbey.
