Feb 23rd 2007 - Sent request For Charges Repaid. £238.00
Feb 28th 2007 - Standard letter received back 'looking into it'
Mar 06th 2007 - Another standard letter stating 'Charges were raised correctly in accordance with tarriff blah blah blah
Mar 06th 2007 - letter before action, Come on!!
Yes thanks, but I'm living without a bank account without any problems, my other half has all d/d's and I deal in cash only.
I've got 2 weeks to sort my court case out as I know A&L will go the whole hog even for 200quid! help with the court thing is what I would really appreciate.
I'm also waiting for Lloyds tsb (SAR pending) i'm taking them for over £3k !
5% Of everything recovered will be donated to CAG!
Sorry I can't do the links thing, but go to the Bank templates library and find the section on 'MCOL Particulars of Claim', it gives you all the advice you need, including a sample of the wording. You need to be v careful with this, cos you're limited for space with MCOL.
They have until Tuesday, my bundle is ready and printed out and I'm now revising my charges, am adding the 8% + expenses before I submit my court claim, is this the right way?
You dont need your bundle yet! look through the step by step procedure, you need to do it all in the right order giving the correct amounts of time between each step. http://www.consumeractiongroup.co.uk...tructions.html
I am just up to the bit where A&L have filed a defence - although haven't yet received my papers from the court regarding this step, so my next will be filling in the allocation questionnaire, the court bundle will be needed once a date has been set, although I am now getting that ready, looking forward to doing battle with one of the Goliaths.
Seriously do look at the step by step procedures as well as everything in the Library - invaluable resources, and read some of the threads on here to see how A&L treat people differently, what system they use is any one's guess, probably thow them all in the air and depending into which square they land depends which route they go.
well, it looks like I can submit my claim to the courts as I today received a letter (dated 16th march) stating that a&l have large investment costs involved in technology associated with setting up direct debit facilities and some of these costs must be passed on to account holders who do not use their accounts properley!
it ends: finally i should inform you that discussions continue between the banking industry and oft regarding current accounts and once the outcome is known, a&l will participate as appropiate!
they have stated in writing that the charges raised are correct in line with blah and they cannot agree to refund these.
I take that as going on to the next stage, right where is the claim form I got from the court, lol.
funny thing is cause I am on low income the claim will cost me nothing.
ANY TIPS ON FILLING OUT THE CLAIM WILL BE GLADLY APPRECIATED, Cheers all.

has any one else had the above as letter from A&L - first time I have seen that line used.
I utilised all the advise in the Step by Step guide and in the library section when I did my N1, and I believe thre is similar guidelines for MCOL. Good luck and be patient, we will all get there in the end.
Well that's the form (N1) filled in and I'm getting ready to toodle off to the local court to fill in my exemption form so I get a free claim!
Done the schedule and added my 8% (£16.27)
Total = £254.00
not a massive claim but my first of 5, get this one out of the way then on to my Lloyds tsb accounts which are a fortune!
will keep you all posted and thanks for the amazing support!

Hi,
Yes, I received the same letter last week.
MCOL filed yesterday, the clock is ticking......tick tock.
Received an ACKNOWLEDGMENT OF SERVICE today with the box tick'd
I INTEND TO DEFEND ALL OF THIS CLAIM.
I'm scared now! (only kiddin)
FROM STEP BY STEP GUIDE:
"B) Acknowledge the claim - this buys them a further 14 days to enter a defence. Some banks will acknowledge the claim and then pay up. They know you MEAN it now! For every threat that gets this far, there are many more that give up long before this point and they know it.
Some will acknowledge the claim, but 'forget' to enter a defence - after 28 days from the date the papers are served on them you will have won by default and you will get all your money back. Once again, you will need to apply for a judgment. If they do not pay you in full, you have every right to send the bailiffs in - this can also be done from the moneyclaim.gov.uk site or by applying in person at your local court (if you started your claim this way). This however is rare."
