    Question being paid by cheque

    hello

    im helping my brother with his claim against Abbeyicon and he was wondering if he could request being paid by cheque if he win the claim????

    could he put it in his POCicon part of the n1 form ????

    He has been paying a debt collectoricon £50 a month to clear this debt and so i asked him to phone abbey to ask if they still owned the debt or have moorcroft (who he is paying back!) had bought it and the lady from abbey replied 'well sort of!!!!????????' and couldnt tell him anything else!!

    how else can he find out this info??

    albbyswife, as far as I can tell, settlement by cheque seems to be the norm anyway. On Moorcroft, I did a Search on Moorcroft Abbeyicon and quite a few threads came up - you might get a lead there. Mind you, shouldn't the person to whom you pay a debt have to provide documentary evidence of "ownership" of the debt ? I think I'm as confused as you are. Regards, Mad Nick.

    I've requested that Abbeyicon pay my son by cheque. They passed the debt to Ist Credit debt collectorsicon. I wrote to the DCA telling them the account was in dispute and to refer it back to their client (abbey). Abbey stopped him using the account in Dec 2005 at which point the overdrawn balance was entirely due to their charges. He does not have access to his account, nor does he have any statements since that date so if they paid anything back into it he wouldn't know. Also the amount being claimed is more than the debt on the account.

    Abbeyicon have just settled my claim. When I spoke to thier solicitors, they stated they pay into the account unless it is closed when they pay by cheque.

    sorry for jumping in but i hope that rule is not absolute ah since Nov they have have charged me an extra 1k with a further £300 due to be added this week. I really don't want the money i have won from charges to go towards clearing more charges!

    bp, obviously once this claim is over, you will be starting a new claim to recover the charges that they very foolishly keep applying, I am on my third claim now and they are STILL apply charges, will they EVER learn??
