When you apply for a credit and fill out the form is this classed as a credit agreement because it doesnt have details on apr on anything or when you recieve the card and phone up to make it active does this class as a credit agreement ?
When you fill in the form it would have to have the APR on it.
Under the Consumer Credit (Agreements) (amendment) Regs 2004, any agreement signed after 31.5.05 has to have the APR as part of its key financial information. If the APR is variable it would also have to state it too.
fingers crossed but what if you applied for your credit card before then ?
If the APR is missing as a "non-prescribed term" under the CCA the agreement would only be enforceable with the leave of the court as it is improperly executed.
