Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Started my action with the request for Data on 20/01/07, prelim letter sent 05/02/07, letter before action sent 19/02/07. Today, 05/03/07, received big letter saying how they feel their charges are just etc, etc, blah, blah, However as a gesture of goodwill offer to pay in full. The only problem if I accept this is I will be agreeing that any further charges will be just. Has anyone any thoughts on this?
Its thought the OFT will soon tell banks to lower the charges anyway. But it depends on your circumastances. If your always being no charged (no offence) then maybe you should seek for the amount with no conditions.
On the other hand if you accepted, it will save a big headache (court etc).
The other thing to bear in mind is that by settling now, you cannot claim the satutory 8% interest.
No offence taken. I'm not always being charged but when I do it snow balls. Starts off £2 over the overdraft, can't get money in, ring to be told they wont extend for a couple of days, and get slapped with 3 or 4 £38 charges. Totally not fair
I've decided to accept the payment in full and just try to stay within overdraft and hopr they lower charges in the future. I'll sort donation when I receive payment. Thanks for all the help
