My sister has been a customer of theres for years! and because she got behind with her payments in sep 2006 they cut her off!
now Moorcroft are dealing with this debt!
I've sent a CCA Request to moorcroft all they did was knock the £1.00 off her account! I have wrote to them to show them the errors of there ways!
I also sent NTL/Virgin media A S A R to claim back her charges! this had the £10 cheque in it of mine! but all the right details of my sisters account her address, name, account number, etc except one of my cheques!
at end of february (I cant even get cable in my area so never had an account with them) I got a letter back in my name to my address, with the returned cheque etc! telling me that there is no account number for me! Has I dont have an account with them! on the very top of the letter was my banks address! But surely My bank will not of given them my address? But I would like to know where they actually got my address from to send this back to me?
Is this just a stalling tactic too?
I'll be putting a couple of letters together tommorow one from myself to them and one from my sister!
To be honest, it might be ticking, but to no avail.
1) Sending a CCA request for an account not regulated under the act is a waste of time, as it is not appropriate.
2) Clearly Virgin cannot disclose a SAR to you if you are not the data subject. However, it your sister simply got you to make out a cheque to them for HER SAR, then they need to be told this - and the cheque returned. If there is any hind of possible data misuse by a third party, they are entitled to refuse, so you need to clarify matters.
3) Your bank would not have disclosed your address, however they have online access to their CRAs database and can make an educated guess as to where you are, unless your letter gave the game away.
My sister got a reply from them today telling her that to get all her statements it will cost her £212 yeah right!
the SAR was sent 31st january So I have just compiled a letter saying that there 40 days are nearly up! and added another cheque for £10 with another copy of the SAR! and showed them the errors of there ways with the £212
