I requested Egg pay back £282.28 in unfair charges and have now received a letter of which point 2 states:
You allege that these charges are a penalty. You have put forward no evidence to support this allegation and we do not accept it. As explained in our previous letter, the charges set out in the Agreement are a genuine pre-estimate of the loss caused to Egg when a customer breaks the terms of their Agreement.
Point 3 then states:
You may have followed recent media cocverage of the OFT investigation into default charges. Following the conclusion of this investigation, the OFT indicated that it would not proceed further against Egg on the basis that Egg reduced its charges from £20 to £16. Without any admission in relation to the previous level of charges, Egg has reduced the charges accordingly. This reduction does not apply retrospectively, but in your case we are prepared, without any admission of lilability, to apply the reduction to the disputed charges. If this is acceptable to you, we will credit your account with a total of £28.00 (being £4 per default charge applied to your account, on the basis of 7 defaults).
And then the 'bribary' on point 5:
We would like to remind you that it is our policy to consider ending out Agreement with you if we feel that the bank/customer relationship has broken down, e.g. in the event of legal proceedings. If we do this, you will no longer be able to use your credit card but will still be liable to repay any balance on the account.
Can anyone give me an idea of what I should write back to them saying? I owe £1500 on the credit card so wonder if it's worth claiming this £282 - but it's MY money at the end of the day... isn't it?
I'm generally ok on wording leters but as this is all in legal terms, I'm worried that I'll type something that is incorrect and not only stand the risk of completely stuffing up my claim, but guaranteed to make a total fool of myself!

just carry on with the process, this is a completely run of the mill, standard bog-off letter. If you have sent the prelim. letter, know what you are claiming back, then just go straight on to the LBA (letter before action)

have you been using the templates form thelibrary and following the step by step guide?
If not may i suggest you have a look, it sounds like you have submitted a prelim letter, their refusal is standard just stick to the step by step guide and you will get your moeny back.

Thanks for your reply. Yes I have followed the step by step guide from MSE and this is just the reply that Egg have sent following my request for charges to be paid back to me. I'll carry on with the next step now.... thanks

Err - hello fluffywr - if you are using the mse sight - the procedures are NOT the same as on here. You would be best to ask for advice on that site - I can't see that CAG members can comment on your letters and methods from another site.

Incidentally i am not certain how MSE suggest you proceed, I havent really looked, I can recommend the one devised and posted in the template library of this site however.

I am not sure which MSE temps you have been using but what I CAN say is that we have had many succesful Egg claims here.With 120k+ members the bulk of whome are actively claiming against the financial institutions I am sure that the information that you will find on this site will be both informative and more importantly ..productive.
