I have just been putting together my initial letter to send to Abbey, asking for £1400 back over the past 14 months.
I will wait and see what happens. I'm quite new to this so am a bit confused when it comes to the 8% interest thing. I understand that I don't need to worry about it until the court stage... is this so?
There also seems to be a few different opinions as to where is best to send letters, so I am sending to PO Box 5129, Milton Keynes MK9 2YN. Does this sound about right? LOL
Just as an update I received Abbey's intial standard response with all the "we are investigating... four weeks... blah blah".
Incidentally they aso said that they had enclosed a copy of their complaints leflet - which they didn't!
Not that it matters... I guess my next stage is to wait until the initial two weeks is up then press aheah with my reminder letter as planned.
Is there a glossary of terms on this site anywhere? I'm getting a bit muddled by all these lba, DPA's and so on that keep getting mentioned in the forums!
As for the address, I sent my letter to 2 Triton Square. The automated response as expected came from Milton Keynes, but I shall be sending the next lba (now I know what that means!) to London again as I feel more comfortable about getting a signature on delivery at that address rather than a PO Box.
Out of interest, if my claim reaches court - I don't think I'd be confident enough to stand up and quote legal issues and to state my case... is it worth finding some legal assitance? And if so, is it OK to do this after the N1 which may not list my representation?
As a general rule i would always recommend serving prelims and lbas on their registered office and i believe that in theory you are supposed to either use the registered office or your local branch.
since the term 'local branch' is open to some interpretation i opt for the registered office.
However, i am pretty sure many people have used the MK offices and i havent heard of anynes claim being struck out as a result.
