Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
After being pointed to this V useful website by MSE, I decided to use the contact.us email address to attempt to recover a one-off £90 "overdraft fee" for dipping below £0 for a few days for the first time in over 2 years. I sent an email based on a simplified version the "initial" letter template, and received a response the next day, saying my email had been forwarded to Service Recovery for attention.
The next day I received the standard supercilious lloydstsb letter that everyone else seems to receive saying:
I understand that:
* You feel that the charges you have incurred are unlawful ....... etc.
BUT
After all the stuff about it's in the terms and conditions etc., one paragraph on side 2 was different from others I have read on this site:
"The above said, I do recognise that your account conduct is usually satisfactory and this does appear to be a genuine oversight on your part. With this in mind I am prepared to refund the £91.18 charge you have incurred." [I didn't even ask for the £1.18 interest! - Then they spoil it all by saying] "I should point out that this is purely as a gesture of goodwill, since you are a valued customer, and not because of the points raised in your letter."
I just wondered if they have a cut off point below which they don't want to trouble their seemingly very busy tame lawyers? I still object to the wording they use, which seems designed to aggrevate people by being so arrogant.
Anyway, post a reply if you got more back with the same, minimal, effort - 1 email.
Thanks to the people behind the website, and Good Luck to all of you going to court soon, especially against LloysdTSB!
